Appointing Musalia Mudavadi as the Cabinet Secretary for all Cabinet Secretaries in Kenya is unconstitutional. According to Article 152 of the Constitution of Kenya, the Cabinet consists of the President, the Deputy President, the Attorney-General, and between fourteen to twenty-two Cabinet Secretaries, each with distinct and specific portfolios. The role of a "Cabinet Secretary for all Cabinet Secretaries" is not recognized within this constitutional framework, and such a position undermines the clear separation of responsibilities and duties outlined for each Cabinet Secretary. This not only breaches constitutional provisions but also disrupts the intended checks and balances within the executive branch, risking the centralization of power and diminished accountability. By creating a role that consolidates oversight, we are putting all our eggs in one basket, which is neither prudent nor democratic. How can we uphold the rule of law if we allow such blatant constitutional violations to go unchecked?

If I were the President, I would direct the National Treasury, and the AG's office to create a continuing programme where Kenya's best lawyers are retained to advise on strategic matters that require constitutional compliance. Secondly, the Attorney General should be required to sign off any major decision of government that has massive legal risks and exposure. The law should further provide that where there is no compliance, the responsible Cabinet Secretaries and Principal Secretaries would be personally liable. The AG should be supported by a competent team that is not necessarily part of the bureaucracy; folks who can see beyond the routine memos,; identify and manage legal risks. How on earth can an important legislation such as the Finance Act; be declared unconstitutional ? Can't they just comply ? Who advises on constitutional compliance? Shouldn't a person who fails to listen to advise be liable ? Are our MPs adequately trained? Do they understand the legal risks when passing a legislation? Do they know the simple yet important concept of "'constitutional supremacy' ? What is the role of the Speaker in guiding the house? What about Committee Chairmen; do they understand the mechanics? Ama ni kiburi tu. Reforming the state requires an organic approach that resets systems and procedures; change of personel at the top never works.
