In the latest episode of An Energized Exchange, Halley Townsend and I discuss what the nondelegation doctrine and an ongoing lawsuit regarding the FTC's noncompete ban could mean for the FTC Green Guides. (Hint: probably not a whole lot in the short term but the nondelegation doctrine is shaping up to be the next major administrative law battle). We give you a reprieve from Chevron/Loper content in this one but we definitely have thoughts about how Loper could impact the Green Guides and climate law generally (And access all of Holland & Knight's Chevron content here: https://lnkd.in/eAzC_zjt). Plenty of additional content coming in the next couple months about how Major Questions, Loper, Nondelegation, and Corner Post interplay with one another and with energy and climate law so stay tuned.
In the latest episode of our "An Energized Exchange" podcast series, attorneys Andy Kriha and Halley Townsend explore the topic of the non-delegation doctrine, specifically in the context of the #FTC's #noncompete rule currently being challenged in a #Texas district court. In addition to providing top-level takeaways, the speakers share why this matters for #energy and #environmental projects, with a particular emphasis on the FTC's Green Guides. New government, new thinking, new challenges? Kier Starmer’s new Labour government certainly has infrastructure investment high on the priority list for driving growth and prosperity across the UK? But how will this be delivered? I discuss the challenges ahead with Andrew Beard, new managing director for infrastructure at global consultancy and construction firm Mace on The Infrastructure Podcast this week and he reckons it is quite clear: ⚡First, cut through the debate and delays seen over the last few years to enable plans to be delivered at pace. ⚡Seek clarity with an agreed and funded pipeline of economic and social infrastructure projects over the next ten years. ⚡Build consistency with a funded, regularly reviewed and regularly updated investment plan. Then, of course, the industry can – and has to – get in shape, modernise and boost its productivity to deliver effective economic social and environment outcomes required..... Putting Thinking First | Helping leaders working for good to make a difference the quiet way | Thoughtful coaching, training & facilitation | Thinking Environment
Recommended listen for civil servants (and other policy wonks!). Yesterday's edition of Leading from The Rest is Politics team is an interview with Lord O'Donnell - former Cabinet Secretary Gus O'Donnell, commonly known as GOD when leading the civil service, thanks to his initials. As you'd expect, plenty of wisdom about managing the civil service/Minister relationship, not only at points of transition. And some thoughts about SpAds, and how the civil service might improve. If you're in this world, you've probably got quite a pile of stuff to listen to and read, thanks to Civil Service World, the Institute for Government and the Institute For Fiscal Studies - all of which are worth a look for informed comment and practical tips. I'd add this podcast to the pile as well. Just under an hour, so perhaps one for a commute on one of your office days this week. #electionpreparation #civilservice

Much of the infrastructure (pipes, ponds, storage systems) in the U.S. were designed based on rainfall and precipitation data from the 1940s through the 1960s. With experts projecting a substantial increase in extreme weather events, our current systems just aren't going to cut it. In this podcast, Dr. Andy Erickson, PhD, P.E., discusses the need for smart stormwater systems that utilize automation for real-time flow management. He also says we need to rethink how we're underestimating both the effectiveness of and our need for green infrastructure, especially in our urban areas. What do you think about more green infrastructure in urban areas? #greeninfrastructure #environmentaldesign #thestormwaterworld
