In the latest episode of An Energized Exchange, Halley Townsend and I discuss what the nondelegation doctrine and an ongoing lawsuit regarding the FTC's noncompete ban could mean for the FTC Green Guides. (Hint: probably not a whole lot in the short term but the nondelegation doctrine is shaping up to be the next major administrative law battle). Much of the infrastructure (pipes, ponds, storage systems) in the U.S. were designed based on rainfall and precipitation data from the 1940s through the 1960s. With experts projecting a substantial increase in extreme weather events, our current systems just aren't going to cut it.
