“Sales tax law is 20 years behind technology.” One of our SaaS clients said this to me and it stuck with me. I totally get why they should feel this way. For SaaS and tech businesses in particular, we find that often state tax legislation simply hasn’t kept up with what is representative of the business circumstances. Tax codes don’t appropriately match and there is a LOT of very important, yet confusing interpretation that needs to happen around sales tax compliance. This is often beyond the expertise of your able finance team. As a SaaS company, how confident are you with all the multistate tax rules out there? I’d love to hear your personal experience. #MultiStateSalesTax #SalesTax #TaxCompliance

TurboTax - a perfect example of how NOT to advertise. The FTC is finally bringing down a few judgements and restrictions upon the maker of TurboTax software for their extremely deceptive marketing practices. For years, the #TurboTax software has been advertising itself as a free tax filing service. Only issue is... after users sign up "free" and then go through the extensive tax filing process, they're brought to a few mandatory payment screens at the end, which must be paid for (subscription, state filing, federal filing) in order to complete your filing. I'm just surprised this massive company got away with this for so long. https://lnkd.in/e2zRryke

5 Sales Tax Compliance Tips for SaaS Companies in 2024. Being based here in Silicon Valley (and being experts in this area of course) means that we work with a high number of growing SaaS businesses. For SaaS companies that sell their software products or services across multiple states, sales tax compliance is a challenging and complex process. Here are 5 tips to make multi-state sales compliance that little bit easier in 2024: 1. Automate Sales Tax Collection and Reporting: Using a sales tax automation software can make sales tax compliance more manageable. 2. Understand Nexus: SaaS businesses must have a physical or economic presence, also known as nexus, in a state before they can be required to collect sales tax in that state. 3. Keep Up with Tax Law Changes: Sales tax laws change frequently, and keeping up with these changes is essential for compliance. 4. Monitor Sales Thresholds: Many states have sales thresholds that trigger sales tax obligations. SaaS companies should track their sales by state to ensure they don't exceed these thresholds. 5. Hire a Sales Tax Expert: For businesses with complex sales tax requirements, it’s often beneficial to consult with a sales tax expert to help navigate the intricacies of multi-state sales tax compliance and minimize the risk of audits and penalties. We can help you with points 2 - 5. We can also assist you with point 1. Please reach out if an introductory call would help get you on track for the year ahead. #SaaS #SalesTax #StateTax #TaxCompliance
