Depending on the forum of the proceedings, the conservatory measures or interim remedies potentially available to a party will differ vastly. Therefore, when drafting dispute resolution clauses, and throughout the life of a dispute, there are a number of considerations that should be borne in mind in respect of interim remedies, including: - Their availability generally and the types potentially available; - Their enforceability outside the jurisdictions in which they are granted; and - Costs implications. These considerations are inter-linked and the reasoning behind them is fairly straightforward. By way of example, in instances where all of the assets of a contracting party are located outside the jurisdiction, or out of the immediate reach of the other contracting party, a serious consideration when drafting a dispute resolution clause, or when the likelihood of a dispute becomes apparent, is the ability to ring-fence those assets to prevent their dissipation. #wat #ciarb #ciarbghanachapter

📊 YoY Comparison of PTAB Filings: A Closer Look Our 2024 PTAB Intelligence Report highlights key trends in IPR and PGR filings over the past five years. IPR filings peaked in 2020 with 1,443 proceedings but have gradually declined, with 1,157 filings in 2023. However, the first half of 2024 suggests stability, with 638 filings already, nearly matching the mid-year total of 2023. PGR filings have seen more fluctuation, with an 86% increase from 2019 to 2020, followed by a decline to 34 filings in 2023. 📉 These trends reflect strategic shifts as companies continue to use PTAB to challenge patents effectively. Additionally, no new CBM filings have been made since September 2020 due to the expiration of the CBM review program, and DER proceedings continue to experience minimal activity.
