Rob Stock: Sunday Star Times. Victims of scams are victims of crime. There is no contributory negligence. When the ombudsman awarded Borja Ares 70 percent repayment from BNZ in the preliminary findings, it resulted in Borja being blamed and penalised 30 percent. It will cost him $93,000, if the decision becomes final. It is accepted that Banks cannot turn a blind eye to the indication of a scam. Borja was trying to pay Citibank via an ASB account. It was a clear breach of skill and care to process this transaction without a warning. As a victim of crime, that breach by BNZ is costing $93,000. Before final decisions are reached, we’ve asked the Banking Ombudsman Scheme to reconsider their stance. Victim support agree.
