How, in a so called capitalistic, free-market economy, can a government entity decide it is lawful to ban new business start-ups by enforcing non-compete agreements? This is so Orwellian, and a throw-back to a time we really don't want to repeat. Future entrepreneurs beware. Do not sign a non-compete agreement. Or if you do, be ready to show the origins of your business ideas and operations, and make sure they are not tied to that employer.

I am sure that many of you have been following this debate and the potential actions concerning the use of non-compete agreements. This HBR article lays out where the issue currently stands and the head-winds that are trying to prevent this FTC action.

The FTC’s new noncompete rule adopts a comprehensive prohibition on the use of noncompete clauses in any U.S. industry with any worker, including those at senior executive levels. The rule is promulgated using the FTC’s authority to determine practices that are unfair methods of competition. For those who have long argued against the use of noncompetes, this moment has been a long time coming. While the rule already faces legal challenges, company leaders would be well advised to make sure they understand what’s in the rule, its potential impact, and what it could mean for employees. Far from being an anti-business rule, the ban on noncompetes stands to spur innovation and grow markets.

More to come . . . * * * * The Federal Trade Commission's ban on non-compete agreements will soon take effect—on September 4, 2024. This significant change leaves many Michigan employers wondering: How can we safeguard our business assets and client/customer relationships in this new environment? Non-solicitation agreements are an effective yet yet often overlooked tool for protecting a business’ interests. As SMBs navigate the post-non-compete world, these agreements offer a viable alternative for maintaining a competitive edge while complying with new federal regulations.
