I love this quote in the article "As the legacy knowledge of deposit gathering is passed down from generation to generation of banker, some of the finer points of liability structuring are getting diluted with some knowledge just plain forgotten about." HOW did we get here? Timeline: 1) A Texas federal judge exempted members of the suing bank, trade group and American Bankers Association from having to implement the rule (at the time, there was a chance the Supreme Court would declare the CFPB’s funding structure unconstitutional, which would have voided the rule entirely. That case was decided in favor of the CFPB earlier this year.) 2) Meanwhile, the Senate and House each voted last fall to repeal the rule 3) President Joe Biden vetoed the matter in December. Exciting news from the Small Business Administration! They are introducing a new structured line of credit designed to provide increased flexibility for lenders and small-business owners. The 7(a) Working Capital Pilot Program will implement a fee structure resembling the agency’s existing Export Working Capital Program and SBA Express loans. This means no fees for loans under a specific threshold, with fees scaling up gradually for larger loans. The #Texas #economy expanded strongly in February according to recent reporting from the Federal Reserve Bank of Dallas. In fact, employment expanded 4.3 percent, well above the nation’s 2.1 percent gains, among other factors including: - Payroll growth strengthened and the unemployment rate remained flat for the ninth straight month, while labor force growth slowed. - The March Texas Business Outlook Surveys (TBOS) indicated modest expansion in the service sector and a slight contraction in manufacturing activity. - Home sales increased in February despite mortgage rates remaining high, while sales tax revenue dipped. Marianne Lake, head of Chase Bank, a division of JPMorgan Chase & Co., has warned 86 million customers about potential new charges on their bank accounts. She stated that proposed regulations capping overdrafts and late fees will lead to significant cost increases for everyday banking services. Chase plans to pass these costs onto customers, affecting currently free services like checking accounts and wealth management tools. The proposed regulations by the Consumer Financial Protection Bureau include an $8 cap on credit card late payment fees and a $3 cap on overdraft charges. Lake emphasized that those most impacted will be individuals who can least afford additional expenses. The changes could also require banks to hold more reserves against mortgages and credit card loans, potentially leading to new fees for services that are currently free. We also foresee that in the future, Chase may require a minimum daily balance in your checking account to keep it open. If and when that happens, we believe other banks like Citibank and Bank of America will adopt similar policies. What are your thoughts

Proposed changes to banker and bank executives employment agreements and how they get paid. How does this effect you, your job, your career, your company? First, the FDIC is proposing new rule on non-competes in regards to mergers (see this article below). Second, the FDIC, OCC, and FHFA have proposed a regulation to prevent incentive based compensation "to prevent leaders of financial institutions from taking on excessive risk in order to boost their personal compensation as this could lead to material financial loss for the firm." (article link in comments). Basically, the first one targets the ability and or how non-competes are used in a merger. The second one targets bonuses and commissions with the old concept of they'll make bad credit decisions to make a bonus or commission. "The credit card net charge-off (NCO) rate reached a multiyear high of 4.82% in the second quarter — 13 basis points up sequentially and 134 basis points up year over year, according to an S&P Global Market Intelligence analysis." "The commercial and industrial (C&I) NCO rate increased 8 basis points quarter over quarter and 17 basis points year over year to 0.48% in the second quarter." "The NCO rate for the multifamily segment was 0.09%, up 4 basis points from the previous quarter and 5 basis points from the same period a year ago." "NCOs declined in three loan segments — auto, construction and other consumer loans. The auto loan NCO rate fell 22 basis points quarter over quarter to 0.99%, which was still 15 basis points higher than in the 2023 second quarter. The NCO rate for construction loans and other consumer loans fell 1 basis point and 3 basis points, respectively."
