How can you ensure both parties are satisfied with mediation outcomes?
For a mediator I think this begins with pre-mediation calls so we avoid surprises at mediation. In a recent insurance coverage case after reviewing the submissions I realized the parties had different positions on the applicable deductible, but were not aware that there was a dispute. By flagging the issue ahead of the mediation I avoided either side feeling like they were blindsided. The attorneys appreciated it and while we did not settle at the first session we ultimately reached a deal that built on the trust developed early on.

How can you ensure both parties are satisfied with mediation outcomes?
Lots of great suggestions by some great mediators. I think lawyers focus on the facts and law in preparing for mediation and sometimes this only further entrenches their client's positions. To me, preparation includes exploring with your client what their interests are and finding out what they need from you to be ready to settle a case that has been going on for a long time. Mentally preparing that mediation day can really be resolution day is key. That can mean different things for different clients. Being flexible and open to new ideas and options is more efficient if that starts during prep.
