What are the types of acceleration claim?! 1. Directed Acceleration This occurs when the project owner explicitly instructs the contractor to accelerate the work to meet an earlier deadline. Remedy: The contractor is typically entitled to compensation for: •Increased labor costs: Hiring additional workers or paying overtime wages. •Additional equipment costs: Leasing or purchasing extra equipment. •Increased material costs: Expediting materials or paying higher prices for faster delivery. •Extended overhead: Costs associated with operating at a higher pace. This compensation is usually requested through a change order or a formal claim for additional time and money. 2. Constructive Acceleration This type occurs when the contractor is not given an extension of time for delays beyond their control (e.g., bad weather, unforeseen site conditions), but the project owner still expects the work to be completed by the original deadline. The contractor is effectively forced to accelerate the work without formal direction. Remedy: The contractor can submit a claim for constructive acceleration, seeking: •Compensation for increased costs: Like directed acceleration, including labor, equipment, and material costs. •Time extensions: For excusable delays that were not formally recognized. In this case, the contractor must prove that they were entitled to a time extension but were forced to accelerate without receiving one. 3. Voluntary Acceleration In some cases, a contractor may choose to accelerate the project voluntarily to complete the work ahead of schedule, potentially to save costs or improve profitability. Remedy: For voluntary acceleration, the contractor typically has no claim for additional costs unless the project owner has agreed to a bonus or incentive for early completion. Any such agreement should be formalized in the contract before the acceleration. 4. Mitigated Acceleration This type arises when a contractor accelerates to mitigate potential delays or reduce further costs due to an unexpected event (e.g., a supply chain issue or equipment breakdown). Remedy: The contractor may be entitled to compensation if the mitigation effort was necessary due to an event beyond their control and the project owner failed to grant an appropriate extension. They could seek recovery of: •Increased costs incurred during the mitigation effort. •Time extensions for unavoidable delays that were reduced but not eliminated by mitigation. In all cases, proper documentation, communication, and adherence to contract procedures are essential for making successful acceleration claims.
