In Law360, partner Tami Stark commented on the regulatory scrutiny of alleged misrepresentations of AI use, or AI washing. She noted that SEC regulators can prosecute AI-washing claims under existing anti-fraud provisions and recommended that companies be accurate in their descriptions of how they use AI. “They need to get up to speed on the technical aspects of the technology that they're using and ensure that those disclosures are full, fair and honest and that they have the technical experts weighing in on that to ensure that they're accurate.” Read more here: https://ow.ly/JKhY50Snvuy #AI

Business Insider quotes Curtis partners Elisa Botero and Michel Paradis on how companies are increasingly turning to lawyers for AI advice. —————— 🗞️The New York-headquartered international firm, Curtis, Mallet-Prevost, Colt & Mosle LLP, has also experienced an uptick in calls from both existing and new clients over the last 10 to 18 months, thanks to AI, according to attorneys at the firm who anticipate even more inquiries in the near future. "What we saw recently with a client of ours in the pharmaceutical space is that they were asked to agree in a contract that they wouldn't use AI in a certain part of the work that they were hired to perform. So we're going to see tons of that kind of interaction in the transactional, contractual space," said Elisa Botero, a partner at the firm. Michel Paradis, another partner at the firm, said companies have also made queries involving confidentiality concerns when it comes to inputting sensitive information into generative AI tools. "AI does have the effect, if nothing else, of putting very sophisticated, very complicated technology in the hands of lots of people who do lots of things and who run into all sorts of regulatory regimes and create all sorts of, let's be frank, legal trouble that they may not even fully understand, that these new tools make possible," said Paradis.

Shook, Hardy & Bacon L.L.P.
Shook Partner Brice Nengsu Kenfack represents clients across the health, science and technology industries as part of his nationwide litigation defense practice. Before becoming a lawyer, Brice moved to the United States to play Division I basketball for Creighton University and later professionally in Europe and the Middle East. Read on to learn how Brice’s experience as a collegiate and professional athlete has shaped his approach in his legal career as part of our celebration of Shook’s athletes this week. SHOOK: How do you utilize the skills from your athletic career in your legal career? BRICE: To be successful throughout my career, it was crucial not only to maintain the skills that got me to where I was (strengths) but I also had to work hard to get better at the things I was not as good at doing (weaknesses). While this may seem cliché, this is one of the most important skills I try to utilize in my day-to-day practice. SHOOK: What principles do practicing law and training for your sport have in common? BRICE: Discipline – being a lawyer requires spending long hours working on solving complex issues. In order to do that, you cannot cut any corners. Just like in sports, staying disciplined is the only way to not fold into cutting corners. Teamwork – I played a team sport. I believe that a successful player in team sports is one who finds the way to make the game easier for his teammates, thereby his team. I believe it is the same in law. Whether you are a partner, associate, paralegal or legal administrative assistant, your success essentially depends on how easy you make the job for others on your legal team.
