JUST IN: Today, we scored a major legal victory for American businesses, workers, and the economy after the U.S. District Court for the Northern District of Texas set aside the Federal Trade Commission’s (FTC) ban on employment noncompete agreements.

The FTC’s Ban on Noncompete Agreements “shall not be enforced or otherwise take effect,” because “the FTC lacks substantive rulemaking authority with respect to unfair methods of competition.”

A big week is ahead as we prepare to file nine amicus briefs, including three at the Supreme Court today. Our amicus briefs advocate for clear and fair legal standards so businesses can focus on growth and innovation. Today, the court granted our motion for a preliminary injunction against the FTC's blanket ban on noncompete agreements.    Daryl Joseffer, Executive VP and Chief Counsel, stated, "This ruling is a big win in the Chamber’s fight against government micromanagement of business decisions. The FTC’s ban is an unlawful power grab that defies its constitutional and statutory authority, setting a dangerous precedent where the government knows better than the markets.
