The Restaurant Law Center is an independent public policy organization affiliated with the National Restaurant Association, the largest foodservice trade association in the world. The Law Center was established to give the industry a voice in the judicial system. Restaurants and other foodservice providers are the nation’s second-largest private sector employers. Through its initiatives, the Restaurant Law Center works to protect and advance the restaurant industry, and promote pro-business laws and regulations that allow restaurants to continue to grow, create jobs and contribute to a robust American economy. The Law Center offers courts and regulatory agencies with the industry’s perspective on legal and regulatory issues significantly impacting it.

Big win on the board today for the Restaurant Law Center and the Texas Restaurant Association! The Fifth Circuit vacated the U.S. Department of Labor’s so-called “80/20/30 Rule,” which governed how tipped employees must be paid under the Fair Labor Standards Act (FLSA), holding that the Final Rule is inconsistent with the FLSA and arbitrary and capricious. Congrats to the RLC and TRA for prevailing against the Administration’s overreach! Congress never intended nor gave the DOL authority to micromanage restaurant operations and employment task-by-task, minute-by-minute, and burden them with impossible recordkeeping obligations. Victory!

I am very pleased to report that earlier today, the United States Court of Appeals for the Fifth Circuit issued a unanimous opinion vacating the Department of Labor's 2021 final rule prohibiting use of the tip credit where employees spend more than a certain amount of time on tasks that do not directly and immediately produce tips. Rejecting more than three decades of agency regulatory and subregulatory overreach, the court concluded that the regulation, often referred to as the 80/20 or 80/20/30 rule, conflicts with the Fair Labor Standards Act and is arbitrary and capricious. This is a great win for our clients the RESTAURANT LAW CENTER and the Texas Restaurant Association. Kudos and thanks to my partner Kathleen Barrett and RLC Executive Director Angelo Amador, who were with me on the briefs. I have been fighting this fight in various courts across the country for the past 16 years, which makes this outcome especially satisfying.

Huge news for restaurants nationwide! The Fifth Circuit Court of Appeals just vacated the Department of Labor's final rule on tip credit. Anyone who (like me) worked as a tipped employee at restaurants knew the rule was wholly impossible for employers to administer. The Court rightly concluded that the rule was both arbitrary and capricious under the Administrative Procedures Act and contrary to the plain text of the Fair Labor Standards Act. NRF was proud to work with Shannon L. Meade and her colleagues at Littler in filing an amicus brief supporting the arguments made by Angelo Amador and the Restaurant Law Center. https://lnkd.in/eGexJsuf
