Oklahoma is the only state we know of that has charged pregnant women with felony child neglect for using medical marijuana — a legal medication. But its court just rejected a dangerous, ridiculous fetal personhood argument that will help protect the rights of pregnant people! This ruling sets a new legal precedent in Oklahoma. At least eight women have been charged under this theory since 2019 — including our clients. If the prosecution succeeded, even more pregnant people would be at risk of criminalization. Becoming pregnant should never be a reason to take away a person’s rights, including their right to use legal medications. Read more: https://lnkd.in/g2xS6HXU
About us
Pregnancy Justice works to ensure that no one loses their rights because of pregnancy or because of their capacity for pregnancy, focusing on pregnant people who are most at risk of state control and criminalization: those who are low-income, of color, and drug-using. We've maintained this mission since we were first established in 2001 as National Advocates for Pregnant Women.

Etowah County officials say they incarcerate pregnant women to "protect unborn life," but their actions prove the opposite. Ashley Caswell almost died giving birth in their jail shower in Alabama — laboring alone for hours and being ignored. We're suing Etowah County officials on Ashley’s behalf with Southern Poverty Law Center & Sullivan & Cromwell LLP for failing to care for her, as they have failed many others.
