    One of the most important things for employees is their pay check. 💰 Every employee wants to be paid for the time that they have worked and most employees want to be paid more for their time. Employers, on the other hand, want to pay employees fairly and in accordance with the various labor and employment laws. As inflation rises and economists look at whether wages have kept up with inflation and the demand for a higher minimum wage continues, plaintiffs’ attorneys and courts are routinely looking at employee wages and employer pay practices. One of the most debated topics in employee compensation is the practice of "rounding" work hours. While this method has been legally accepted for years, it is now being questioned for its fairness. A recent case in California, Camp v. Home Depot U.S.A. Inc., has brought this issue into the spotlight. The California Court of Appeal scrutinized the practice of rounding hours and its potential impact on employees' pay, and the case is now awaiting review by the California Supreme Court. This situation serves as a reminder for employers to be cautious in their rounding practices. 💡 Historically, both California and federal laws have allowed employers to round work time to the nearest quarter-hour. For example, if an employee worked less than 8 minutes, the time could be rounded down; if they worked 8 minutes or more, it could be rounded up. While this practice was deemed neutral and permissible, modern technology—such as time clock apps and automated payroll systems—now provides precise tracking of work hours, making it harder to justify rounding. The Home Depot case highlights that if an employer’s rounding practices systematically disadvantage employees, it could lead to legal challenges. Employers should revisit their pay practices to ensure they are not only legal but also fair and transparent.     Did you hear about the staffing agency that faced nearly a 7-figure payout? 😬 Our Senior Attorney at myHRcounsel, Britt Waterman, offers her expert insights on this significant case. Don't miss what she had to say—check it out below! ⬇️ "Staffing agencies operate on narrow margins and face high competition in the market. It isn’t surprising to see contracts between a staffing agency and a client where what the client wants is what the client gets, without review by employment law counsel or a broader understanding of the law. Staffing agencies may give into client requests that seem unusual or improper just to keep the client, and perhaps think any consequences will ultimately fall on the client. But following that procedure all led up to one staffing agency that recently settled its lawsuit with the EEOC for an $875,000 fine, as well as the requirements that the staffing agency hire an independent contractor to draft and implement discrimination and harassment policies and bring on a third party to train managers and recruiters on sex discrimination and anti-discrimination policies. No small hit to the staffing agency. So what did the staffing agency do to subject themselves to this enormous penalty? Managers directed recruiters to comply with some clients’ requests to send only male candidates for certain positions. Some clients requested only men for jobs that were labor intensive, or historically staffed by a higher percentage of men than women. The recruiters played along with the client’s blatant sex discrimination and told women that these jobs were unavailable. Recruiters who objected had their concerns dismissed. Why did the EEOC come down so hard on the staffing agency when it was the client who made the request in the first place? If a staffing agency engages in discriminatory, retaliatory, or harassing conduct toward its own employees (here, by sending only men to the client and falsely telling women the jobs were unavailable) the staffing agency is responsible, even if the agency only engaged in the conduct to comply to a verbal, written, or contractual request from the client. Staffing agencies are advised to seek legal counsel when faced with a request from a client that may come back and stick the agency with an almost million-dollar payout.
