Have your say in hemp policy’s future, submit your comments today! As we shared a few months ago, the U.S. Hemp Authority (USHA) – the #hemp industry’s self-regulatory organization – announced plans to introduce an adult cannabinoid certification program, to complement its existing standard for non-intoxicating products. Hemp products with the potential to impair – such as Delta 8- and Delta 9-THC – have proliferated with no federal regulation in recent years, leading to growing concerns about quality, safety and access by minors. The adult standards – linked below – were developed by an expert Technical Committee and approved by the USHA Board of Directors. Major thanks go out to USHA President Chris Fontes for his steadfast leadership, and to hemp super-lawyer Rod Kight for penning the final draft. Now it’s your turn. Today launches a 30-day public comment period, during which we are asking hemp industry stakeholders – farmers, processors, manufacturers, brand owners, store proprietors – to weigh in with their thoughts, amendments, ideas, and suggestions. For the first time since the 2018 Farm Bill became law, the U.S. Supreme Court will decide a case about hemp. The case—Medical Marijuana, Inc., et al. v. Douglas J. Horn—involves the Racketeer Influenced and Corrupt Organizations Act (“RICO”) and asks whether product manufacturers can be held responsible for a person’s lost earnings and other job benefits under that powerful statute. Earlier this week, the Roundtable filed a “friend of the court” brief supporting the defendants’ position that Congress did not intend RICO to apply to personal injury losses. As the brief argues, expanding RICO has major implications for the hemp products industry. Increased costs will be passed on to consumers, potentially making products unavailable to people who need them. And worse, more liability may cause manufacturers, distributors, or retailers to exit the industry entirely, which will reduce economic opportunities for hemp farmers and businesses. Yesterday, the House Appropriations Committee unfortunately added the hemp-killing Mary Miller language to the Agriculture Spending Bill. If signed into law, the language would fundamentally change the definition of #hemp on the federal level and have a disastrous impact on the hemp industry by banning all hemp products that have a hint of THC, essentially outlawing hemp entirely. There is a chance to fix this, though: thanks to rigorous negotiation from hemp activists and Rep. Dan Newhouse, the Committee also officially called for regulation - not prohibition - of hemp that is in line with the principles supported by the hemp industry. This will prove critical in the upcoming debates and negotiations as we work to fix the bill's language and save hemp. The fight has just begun.
