The Harbor Trucking Association and the The So Cal Supply Chain Meetup have been working together to put on events for several years now…this one should be quite insightful. If you don’t know what an #ISR is…you might want to check this out. Always glad to have #HTA board member Jim Gillis representing #Drayage trucking and a big shout out to my long time colleague Ian MacMillan from the South Coast Air Quality Management District for accepting our invitation to come help folks understand the nuances of what the heck a #WAIRE is. #HTA members Daniel Loflin from Prologis and Stephanie Bewick from NavTrac (Acquired by Loadsmart) will no doubt help fill in the blanks on this critical discussion and help those who are operating a #warehouse over 100k Sqft in the #SCAQMD figure out WAIRE and how they fit into Rule 2305. Looking forward to having Walker Banks, MBA from PortPro weave it all together. This wouldn’t be possible without the hard work and commitment of Karla Sánchez-Jiménez and Melissa Summers at #HTA. One. Step. Closer. Hard to believe we have *almost* finally reached the finish line on a universal/agnostic appointment system at the Port of Los Angeles and Port of Long Beach… The Harbor Trucking Association and our members have been pushing for a single interface for as long as I can remember…An offical ask happened in January of 2023 with a letter to both Gene Seroka and Mario Cordero that came from both #HTA and our partners at the California Trucking Association (for some added umph)…just a scant 18 months later and we are almost there! Thanks to the leadership at both #Ports and the unrelenting commitment to seeing this through from our friends at the California Governor's Office of Business and Economic Development (GO-Biz) and my friend and colleague Trelynd Bradley….we are so close I can almost smell the efficiency gains…. My favorite part will be having actual data on how many appointments are released by #MTO by shift, how many of those are booked, how many are cancelled and how many are fulfilled in order to get a better understanding of utilization across both shifts and ideally find a more efficient approach to gate availability and hours…(#DoubleFlex anyone?) This is a big deal and was no small task to get both ports to work together on making our dream a reality. Kudos to all those who helped move the needle on this!
Today, we announced the award of $27 million to support data system development and interoperability across California’s five containerized ports, the first-ever state-level funding in the country focused on improving data functionality across a statewide network of ports! As the nation’s premier gateway for international trade, California and its ports are essential to the smooth functioning of the global economy. The state’s containerized ports, which include the Port of Los Angeles, Port of Long Beach, Port of Oakland, Port of San Diego, and Port of Hueneme, handle a staggering 40% of all U.S. containerized imports, supporting millions of jobs and generating billions in economic activity. The awards will fund ten innovative projects across the five ports that address key challenges in port operations and foster long-term statewide freight resilience. These projects encompass a wide range of solutions including optimization of cargo-routing, deployment of cutting-edge technologies such as artificial intelligence, implementation of climate resiliency and emissions reductions measures, adoption of trucking appointment systems, and the development of new data standards for cargo. cc: California State Transportation Agency https://lnkd.in/gMzJ-bkm

While according to the US COURT OF APPEALS the Federal Maritime Commission may have missed the mark in this particular case on applicability of #detention charges when terminals are closed, the result here should most definitely set up a larger conversation about when fees can be reasonably assessed… For those who have been paying attention, the details of this case DO NOT translate across all #US maritime gateways, especially those terminals that require appointments…(is it reasonable to consume free time and then subsequently charge even if no appointments were available to return (or pick up) a container before #LFD?) In the State of California (where all major container terminals require appointments), B&P code section 22928 is crystal clear in this question and no doubt legislative intent centered on the concept of fairness in applicability of these fees. Traditionally, once a container is out of FT, the #DnD clock ticks even if a terminal is closed…as of 1/1/2023, in #California that is technically a violation of 22928 (a quick Google search of the code section will yield results) and while there isn’t an #FMC small claims pathway to challenge fees under this state statute, Small Claims Courts in the Golden State are open for business should someone find the chutzpah to challenge an #EP on unfairly applied charges… The entire #Drayage industry (and by extension our customers) should commend the folks at TCW for pushing the issue and challenging EVERGREEN LINE’s policy on #DnD assessment at the Federal level…unfortunately for Yamaha Motor Corporation, USA and #TCW, the Agency at this juncture wasn’t able to articulate why this particular situation should be considered unreasonable within the confines of the #ShippingAct and the incentive principle…at least enough to convince the D.C. Circuit that is… Interesting case to read and again ideally the start of a much more comprehensive conversation about reasonableness in fee applicability, especially in California where pretty much every #EP/#OceanCarrier is currently violating state law.
