Title VII of the Civil Rights Act of 1964 prohibits employment discrimination with respect to compensation, terms, conditions, or privileges of employment based on race, color, religion, sex, and national origin. In Muldrow, the Supreme Court decided that Title VII does not explicitly require a showing of substantial harm, reversing the lower courts, finding instead, “[a]lthough an employee must show some harm from a forced transfer to prevail in a Title VII suit, she need not show that the injury satisfies a significance test. Title VII’s text nowhere establishes that high bar.” An immediate practical impact of this decision is that courts will use a different definition of “harm” in employment discrimination claims brought under Title VII. In the aftermath, commentary has emerged about the broader Diversity, Equity, and Inclusion (DEI) consequences of the decision. If you need help managing your workplace policies, reach out. We dug into some key lessons ethical hackers have noted for businesses, and here’s what we found: 👉 Security is a journey, not a destination 👉 Providing scripts to your team members makes it easier for them to know what to say (and to say no). 👉 Security is everyone’s responsibility. Gartner identified employee conflict resolution as a must-have skill for managers in 2024. Their research highlights that “Managers who manage, rather than silence, interpersonal conflict among employees will have an outsize positive impact on their organizations.” And while these interpersonal skills can be developed by managers through training and practice, an employee conflict policy plays a critical role too. We've outlined what an employee policy is in our graphic below. If you'd like more information, click over to our detailed Insight via our website. If you're looking to improve your employee retention, it’s important that you document the key components of your culture. It’s challenging to retain employees for the long-term when your public-facing documents and/or leadership and hiring team tell potential hires that the culture is one thing, when the reality is something completely different. We suggest focusing on documenting the policies that really impact your employees in their day-to-day such as: 👉 Personal development budgets. 👉Mentorship opportunities. 👉Volunteering opportunities. 👉Hybrid or flexible work arrangements. 👉Feedback and/or complaint processes. 👉Diversity and inclusion. If you need assistance updating your employee handbook, reach out. Our employment attorneys would love to help 💡
