📢 CAIDP Releases "Still No Guardrails" Report - Urges Congress to Press FTC Commissioners on OpenAI Investigation 🔥 🔥 🔥 🗣 Prior to a Congressional hearing on the Federal Trade Commission, the Center for AI and Digital Policy released a new report - "Still No Guardrails" - to call attention to the FTC’s failure to act on the complaint CAIDP filed with the FTC about OpenAI in March 2023. 📰 In July 2023, both The New York Times and The Wall Street Journal reported that the FTC had undertaken the investigation CAIDP requested, but a year later there is still no outcome and no guardrails for the most widely deployed commercial AI product in the world. 🔥 CAIDP warned that commercialized AI services will turbocharge risks to public safety, online child safety, cybersecurity, deception, and election integrity. A study led by Alondra Nelson at the Institute for Advanced Study (IAS) revealed that AI chatbots delivered false election information at least 50% of the time. CAIDP urged Congress to ask the FTC Commissioners about the status of the OpenAI investigation and specifically when there will be an outcome. 🔥 "We believe the longer the FTC waits to act, the more difficult it will be to establish safeguards for ChatGPT and other similar AI services." 🔥 "The safe, secure, and trustworthy development of artificial intelligence is critical for the American economy, consumer protection, public safety, and national security." 📢 CAIDP Provides Comments to Civil Liberties Board on AI and Counterterrorism 🔥 CAIDP explained, "AI systems that claim to detect emotions, thoughts, or truthfulness from physical features, conversations, and expressions are pseudoscientific and discriminatory." 🔥 CAIDP also wrote, "The Board must exercise its oversight authority to ensure that rights-impacting AI systems are not deployed and entrenched in counter-terrorism and national security efforts." 🔥 Regarding a key advisory board, CAIDP said, "If DHS seeks to fairly evaluate public concerns of implementing AI systems into counterterrorism and national security efforts, the DHS should establish clear measures to address conflicts of interest that would arise from the corporate/industry members on its Board." Devices Want More of Our Data,” by Brian X. Chen (Tech Fix column, June 26): 💡 "Mr. Chen makes a good point about the privacy and security risks of companies collecting customer data to train artificial intelligence models. But the companies are not waiting for user permission to repurpose this data. They assume they can do this unless customers object." 🤔 "In a recent statement to Slack, we opted out of its plan to use our data and the data of our friends and colleagues who collaborate with us for training A.I. models. We cannot assume that they would want their content, created for our common projects, to be used by the company for other purposes. ➡ "We have also urged Slack to withdraw the proposed change in its business practices and adopt an opt-in model for the use of customer data for A.I. training. 🔥 "If some users wish to provide their data to Slack for A.I. training, that should be their choice. But it is simply unfair and deceptive for Slack to take user data without explicit permission, particularly after it announced, “You own and control the content within your Slack workspace.” 🔥 🔥 "We have also notified the Federal Trade Commission of our concerns." 📢 CAIDP Advises US Congress on Privacy Legislation, Focuses on Need to Strengthen AI Provisions In a statement issued in advance of a meeting in Congress to consider the American Privacy Rights Act, the Center for AI and Digital Policy urged US lawmakers to strengthen key provisions concerning AI systems. As CAIDP explained, "We support this long-awaited step towards a federal privacy law. This work is urgent given the growing risks to public safety and civil liberties. Many AI systems rely on the collection of personal data. These systems diminish privacy and are used for mass surveillance. AI systems pose new challenges for privacy, dignity, autonomy, and equality." 📢 OECD Publishes Report on AI, Data Governance, and Privacy In the age of rapid digital transformation, the OECD.AI has published a report that highlights six critical policy considerations to ensure that AI systems are effective and respect user privacy : 1. Ensuring transparency in AI systems 2. Safeguarding data privacy 3. Enhancing data security measures 4. Promoting data access and sharing 5. Encouraging international cooperation 6. Regulating AI technology use effectively ➡ As the OECD explains, the report "maps the principles set in the OECD Privacy Guidelines (1980) to the OECD AI Principles (2023), takes stock of national and regional initiatives, and suggests potential areas for collaboration." ➡ "The report supports the implementation of the OECD Privacy Guidelines alongside the OECD AI Principles. 📢 CAIDP Provides Comments to Australian Government on Online Safety Act and AI 🇦🇺 In comments to the Australian Government, the Center for AI and Digital Policy wrote, "the online risks which accompany the advent of generative AI are extensive, and include threats to personal privacy, intellectual property, and life-altering outcomes based on AI-enabled decision-making." CAIDP thanked the Australian government for the opportunity to provide public comments on proposed changes to the Online Safety Act and made several specific recommendations concerning AI: 1️⃣ Establish redlines for developers, providers, and deployers of AI systems regarding training data, prohibiting practices which contravene the Australian Privacy Principles, including web-scraping of personal data and intellectual property. 2️⃣ Require transparent and contestable data provenance for AI models trained on web-scraped data so that data subjects may be made aware when their personal, private data and intellectual property has been used to train AI models, providing an opportunity for compensation and extrication of data. 3️⃣ Require rigorous, independent impact assessments prior to deployment to identify and mitigate potential online harms, including biases and rights violations, with ongoing re-assessments across the AI lifecycle. 4️⃣ Require algorithmic transparency for AI systems so that users are aware when they are interacting with an AI/algorithmic system and are provided with clear and valid reasons for outcomes affecting their lives. 5️⃣ Require human oversight and control over AI systems operating online and an affirmative obligation to terminate if human control of the system is no longer possible and/or if the system fails to uphold human/civil rights in keeping with the Universal Guidelines for AI, a precursor to the Australia-endorsed UNESCO Recommendation on the Ethics of Artificial Intelligence.
