Software programs used by election denier activists are lending a veneer of sophistication to long-discredited claims that ineligible people are voting in significant numbers. But these tools use unreliable or outdated.

We are a nonpartisan law and policy institute that seeks to improve our systems of democracy and justice.
About us
The Brennan Center for Justice at NYU School of Law is a nonpartisan law and policy institute that works to reform, revitalize – and when necessary, defend – our country's systems of democracy and justice. At this critical moment, the Brennan Center is dedicated to protecting the rule of law and the values of Constitutional democracy. We focus on voting rights, campaign finance reform, ending mass incarceration, and preserving our liberties while also maintaining our national security. Part think tank, part advocacy group, part cutting-edge communications hub, we start with rigorous research. We craft innovative policies. And we fight for them – in Congress and the states, the courts, and in the court of public opinion.

The Insurrection Act grants presidents extremely broad and effectively unreviewable discretion to use the military as a domestic police force. The law must be reformed.

Today, we’re announcing a $30 million commitment from philanthropist and businessman Jim Kohlberg to build a new center focused on reforming the Supreme Court. The Kohlberg Center on the U.S. Supreme Court will invest over the long term in research, public education, and policy advocacy for Supreme Court reform. It will build on our work on Supreme Court term limits and ethics reform while also incubating new ideas, such as reforms relating to the shadow docket, the Court’s power to pick cases, and Congress’s ability to respond quickly to rulings. Public demand for #SCOTUS reform is growing. A series of ethics scandals and recent contentious rulings are undermining the Court’s legitimacy. It’s time to make the court accountable to the people. In the wake of President Biden’s announcement that he will not be running for reelection, a significant question that has come up is what happens to his sizable campaign war chest. I posted some thoughts on X (f/k/a Twitter). The gist: the president’s campaign committee also belongs to VP Harris—it is their joint reelection committee. While the law and FEC regulations do not address this precise situation, I and most experts I know believe the money is legally at her disposal, and my guess is that the FEC will agree. Things get a bit more complicated if there is an entirely new ticket, which cannot directly access the money. But the money can still be transferred to the DNC and other party committees, which are free to spend it to support the new nominees. https://lnkd.in/eyvpH9dn For other questions about what happens next now that the president has withdrawn, see this statement by the National Task Force on Election Crises that includes several of my Brennan Center for Justice colleagues: https://lnkd.in/ejdJhZzw

Election deniers’ tactics include attempts to intimidate voters or election workers, as well as baseless challenges to voter eligibility. We’ve created resources detailing the federal and state laws that protect the right to vote from such efforts. https://bit.ly/3W8sytj

The election denial movement has spurred efforts that are ostensibly to maintain the integrity of elections but in reality threaten to suppress the vote and interfere with proper election administration. Fortunately, there are numerous legal defenses. https://bit.ly/3W8sytj
