Have state-chartered, FDIC-insured banks finally achieved interstate usury parity with national banks? In this week’s Consumer Finance Monitor Podcast episode, which repurposes a recent webinar, Burt Rublin, Joseph Schuster, Ron Vaske, and Kristen Larson join Alan Kaplinsky for an episode examining the impact (if any) of a recent landmark opinion from the District of Colorado in a case challenging recently enacted Colorado legislation on interstate loans made from outside the state to state residents. As a starting point, the panelists open with a brief history of the interest rate exportation authority of national and state-chartered banks, and theories developed by opponents to attack those exportation powers. They then discuss the Depository Institutions Deregulation and Monetary Control Act of 1980 (DIDMCA) before turning to the “opt-out rights” conferred on states under Section 525 of DIDMCA, states that have attempted to exercise or broaden this right (including Colorado’s recent adoption of an opt-out statute), and the preliminary injunction granted by the district court in favor of the plaintiffs, which is now on appeal to the 10th Circuit. Their discussion continues with details of the current court challenge to the Colorado opt-out statute, including a close examination of the statute itself, the state’s enforcement position, and the complaint filed by the plaintiff trade associations seeking to strike down the statute. Finally, they put the current matter in context by providing thoughts about the potential effect of the Colorado litigation on Iowa’s opt-out statute, a survey of opt-out legislation pending in other states, and how the Colorado litigation might affect the future of opt-out laws in these and other states. The U.S. Department of Labor has updated its 2021 cybersecurity guidance to clarify that it applies to all employee benefit plans. Equality Forum has given its 10th Annual Frank Kameny Award, which honors pioneering individuals and organizations who have made a difference in LGBTQ civil rights and justice, to the Philadelphia LGBTQ Bar Association. LGBTQ Bar Association President Elizabeth Weissert, who is an attorney in Ballard Spahr’s Antitrust and Competition Group, spoke to The Philadelphia Gay News about the organization’s history and the significance of this award. “The award has provided a really great opportunity for us to recognize the decades of lawyers who have come before us,” Liz said. “In many ways, things are easier for us and the profession is much more inclusive than it was 30 and 40 years ago because of them.” Liz is picture below with Rue Landau, Philadelphia's first openly LGBTQ city council member, at left; and Malcolm Lazin, executive director of the Equality Forum, at right.
