Dealing with conflict on interest in investigation is tough because the credibility of the investigation could come in question unless: 1) a thorough declaration of the conflict of interest is made openly and transparently to relevant stakeholders. In case the conflict of interest is significant, recusing oneself is recommended. 2) all evidence captured and presented is done from acceptable source of truths, ensuring proper documentation and following laid out procedure. 3) Decision are taken through a neutral party or under the Supervision of a neutral party. 4) Principals of natural justice i.e Rule against Bias, Hearing all sides before deciding and reasonability of decision are followed.

It is obvious that at times in your career of HR there might be a moment when such situations do occur. My take here is following 3 steps 1. Be honest and put all conflicts on the table and to stakeholders. 2. Continue with investigation and keep sharp eye on witness and evidences rather than to emotions. 3. If you are not confident of staying objective to the cause please involve 3rd party immediately and accept findings Awareness and Honest approach to this case is the key.

When there is a chance of conflict of interest and that investigation's final report can be influenced by me, then I prefer to disclose immediately and at first place I like to handover to someone who can be more authenticated and transparent. If there is no one else, then I would be intimating all the team members in advance about this and try to share the regular updates. At the same time I would keep my integrity as this shouldn't make me feel guilty or shouldn't reduce my confidence levels. Keeping my head high I will take this ahead by keeping the transparency intact.
