Apartment Snapshot Mobile App Privacy Policy  

Introduction

Apartment Snapshot LLC. and its affiliated entities (“we”) are committed to protecting the privacy of individuals and achieving and maintaining the trust of our leasing professional and apartment community clients (“Snapshot Clients”). This policy describes:
  • The types of information we may collect or that Snapshot Clients may provide when they purchase, download, install, register with, access or use Apartment Snapshot (the “App”).
  • Apartment Snapshot’s practices for collecting, using, maintaining, protecting and disclosing that information, including the personal data provided by individuals (e.g., potential renters) to Snapshot Clients.
  • This policy applies only to information we collect in the App and in email, text, and other electronic communications sent through or in connection with the App (for example, the App’s in-app chat feature)
This policy DOES NOT apply to information that:
  • We collect offline or on any other Snapshot apps or websites
  • You provide to or is collected by any third party (see Third-Party Information Collection).
Apartment Snapshot websites and other apps, and these other third parties, have their own privacy policies. We encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding the information we receive through the App, and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the App. By downloading, registering with, or using the App, Snapshot Clients agree to this privacy policy. 

APARTMENT SNAPSHOT CLIENTS ARE RESPONSIBLE FOR THE PRIVACY OF ALL PERSONAL INFORMATION OF THEIR OWN CUSTOMERS. THIS SHOULD INCLUDE DISCLOSING THE INFORMATION CONTAINED IN THIS PRIVACY POLICY TO SUCH CUSTOMERS, AS WELL AS THE APARTMENT SNAPSHOT CLIENT’S EMPLOYEES, VENDORS AND OTHER AFFILIATES.

This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the App after we revise this policy means you accept those changes, so please check the policy periodically for updates.

Description of the App

Apartment Snapshot is designed to enhance the reporting experience for apartment operators and owners. The app allows operators to set key performance indicators to measure their team and a property’s performance with the ability for employees to have access to this data and monitor progress. 

Children Under the Age of 18

The App is not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at [email protected].

California residents under 16 years of age may have additional rights regarding the collection and sale of their personal information. Please see Your California Privacy Rights for more information.

    Users Outside of the United States

    The App and its services are hosted in the United States and are governed by the laws of the United States. Apartment Snapshot does not intend the App to be downloaded, accounts registered by, or used by users outside the United States, and does not market to users outside the United States. If you are using the App outside the United States, please be aware that your information will be transferred to, stored and processed in the United States where Apartment Snapshot servers and databases are located (therefore transferred outside the European Union (“EU”) and European Economic Area (“EEA”)). By using the App, you consent to the transfer of information to countries outside your country of residence.

      Information We Collect and How We Collect It

      We collect information from and about users of the App:
      • Directly from Snapshot Clients when they provide it to us.
      Information You Provide to Us 
      When you download, register with, or use the App, we may ask you provide information:
      • By which Snapshot Clients and their customers may be personally identified, such as name (“personal information”).
      • That is about Snapshot Clients and their customers but individually does not identify them, such as device IDs, usage history or past logins.
      This information includes:
      • Information that Snapshot Clients provide by logging into the Apartment Snapshot App. This includes information provided at the time of registering to use the App, subscribing to Snapshot’s service, posting material, and requesting further services. We may also ask Snapshot Clients for information when they report a problem with the App.
      • Records and copies of Snapshot Clients’ correspondence (including email addresses and phone numbers, in-app chat logs), if they contact us.
      • Details of transactions Snapshot Clients carry out through the App and of the fulfillment of Snapshot’s services, such as the creation of guest cards and communication logs with prospective renters.
      Automatic Information Collection and Tracking
      When Snapshot Clients download, access and use the App, it may use technology to automatically collect:
      • Usage Details. When Snapshot Clients access and use the App, we may automatically collect certain details of their access to and use of the App, including screens viewed, logs, and other engagement data and the resources that Snapshot Clients access and use on or through the App.
      • Device Information. We may collect information about Snapshot Clients’ mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.
      • Stored Information and Files. The App also may access metadata and other information associated with other files stored on a Snapshot Client’s device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
      • Location Information. This App does NOT collect real-time information about the location of a Snapshot Client’s device.
      If you, as a Snapshot Client, do not want Snapshot to collect this information, do not download or use the App, or delete it from your device.

      Information Collection and Tracking Technologies
      The technologies we use for automatic information collection may include:
      • Cookies (or mobile cookies). A cookie is a small file placed on a Snapshot Client’s device. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access certain parts of the App.
      • Crash Reporting. Crash reporting creates detailed reports of the errors in the App. Errors are grouped into clusters of similar stack traces and triaged by the severity of impact on users. We may also log custom events to help capture the steps leading up to a particular crash in the App.

      Third-Party Information Collection
      When you use the App, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:
      • Your mobile device manufacturer.
      • Your mobile service provider.
      • Property management software platforms that integrate with the App, such as Yardi, Real Page, and Entrata
      These third parties may use tracking technologies to collect information about you, as a Snapshot Client, when you use the App, and your customers and other potential renters. The information they collect may be associated with your personal information or your customers’ personal information, or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

      WE DO NOT CONTROL THESE THIRD PARTIES’ INFORMATION COLLECTION TECHNOLOGIES, TRACKING TECHNOLOGIES, OR HOW THEY MAY BE USED. THESE THIRD PARTIES HAVE THEIR OWN PRIVACY POLICIES, WHICH WE ENCOURAGE YOU TO READ BEFORE PROVIDING INFORMATION ON OR THROUGH THEM. If you have any questions about an advertisement or other targeted content on your device, you should contact the responsible provider directly.

      How We Use Your Information

      We use information that we collect about Snapshot Clients or that they provide to Snapshot, including any personal information belonging to a customer of a Snapshot Client, to:
      • Provide you with the App and its contents, and any other information, products or services that Snapshot Clients request from us.
      • Fulfill any other purpose for which Snapshot Clients provide it.
      • Give Snapshot Clients notices about their account or subscription, including expiration and renewal notices.
      • Carry out our obligations and enforce our rights arising from any contracts entered into between Snapshot Clients and Snapshot, including for billing and collection.
      • Notify Snapshot Clients when updates for the App are available, and of changes to any products or services we offer or provide though it.
      The usage information we collect helps us to improve the App and to deliver a better experience for Snapshot Clients and their customers by enabling Snapshot to:
      • Estimate our user size and usage patterns.
      • Store information about Snapshot Clients’ preferences, allowing us to customize the App according to their individual needs and business practices.
      • Recognize Snapshot Clients when they use the App.

      Disclosure of Your Information

      We disclose aggregated information about users of the App and information that does not identify any individual or device without restriction.
      In addition, we disclose personal information that we collect, including personal information provided by Snapshot Clients:
      • To Snapshot’s subsidiaries and affiliates.
      • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
      • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Snapshot’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Snapshot about the App’s users is among the assets transferred.
      • To fulfill the purpose for which Snapshot Clients provide it. For example, if a Snapshot Clients gives us an email address of a potential renter, we may transmit that email address to third party property management vendors, including but not limited to Yardi [https://www.yardi.com/], and RealPage [https://www.realpage.com/].
      • For any other purpose disclosed by Snapshot when they provide the information.
      • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
      • To enforce our rights arising from any contracts entered into between you and us, including the App’s EULA [https://www.apple.com/legal/internet-services/itunes/dev/stdeula/], terms of sale, and for billing and collection.
      • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Snapshot, Snapshot’s customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
      While we cannot control our third party vendors’ collection or use of Snapshot Clients’ information or the information regarding Snapshot Clients’ customers, these third parties may provide you with ways to choose not to have your information collected or used. Please contact these third party vendors for additional information on their practices, policies and opt-out rights.

      Your Choices About Our Collection, Use, and Disclosure of Your Information

      We strive to provide Snapshot Clients with choices regarding the personal information they choose to provide to Snapshot. This section describes mechanisms we provide for them to control certain uses and disclosures of over their information and the information provided by Snapshot Clients or their customers.
      • Tracking Technologies. You can choose whether or not to allow the App to collect information through other tracking technologies through the device’s privacy setting or by disabling or fusing cookies. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the App may then be inaccessible or not function properly.
      • Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the App may then be inaccessible or not function properly.

      Accessing and Correcting Your Personal Information

      Apartment Snapshot Clients can review and change their personal information by logging into the App and visiting their account profile page.

      Apartment Snapshot Clients may also send us an email at [email protected] to request access to, correct, or delete any personal information that they have provided to Snapshot. We may not be able to delete all personal information of a Snapshot Client except by also deleting their user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

      Your California Privacy Rights

      If a Snapshot Client or a customer of a Snapshot Client is a California resident, California law may provide them with additional rights regarding our use of personal information. To learn more about your California privacy rights, visit [https://oag.ca.gov/privacy/ccpa].

      California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of the App who are California residents to request certain information regarding Snapshot’s disclosure of personal information to third parties for direct marketing purposes. Snapshot DOES NOT DISCLOSE PERSONAL INFORMATION TO THIRD PARTIES FOR SUCH PURPOSES. To make such an inquiry however, please send an email to [email protected].

      Data Security

      We have implemented measures designed to secure the information provided to Snapshot by Snapshot Clients from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

      The safety and security of your information also depends on each Snapshot Client and their own practices regarding their customers’ personal information. Where we have given a Snapshot Client a password for access to certain parts of the App, they are responsible for keeping this password confidential. We ask each and every Snapshot Client not to share their password with anyone.

      Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of the information provided by Snapshot Clients through the App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

      Changes to Our Privacy Policy

      We may update our privacy policy from time to time. If we make material changes to how we treat our the personal information of Snapshot Clients or their customers, we will post the new privacy policy on this and notify you either by email to the email address specified in the Snapshot Client’s account, or with an in-App alert the first time you use the App after we make the change.

      The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
