    😡 Relationship breakdown is costly for the people involved and damages productivity and profitability. 🙂 Fortunately, broken relationships can be fixed. Here’s a 4-point plan to help your team manage conflict in the workplace effectively: 1️⃣ 𝗘𝗮𝗿𝗹𝘆 𝗶𝗻𝘁𝗲𝗿𝘃𝗲𝗻𝘁𝗶𝗼𝗻 Equip managers with the skills and expertise to be alert to conflict and unafraid to explore issues as they arise. Conflict that remains unchecked can lead to entrenched positions and damaged relationships that become more difficult to resolve. 2️⃣ 𝗜𝗻𝗳𝗼𝗿𝗺𝗮𝗹 𝘀𝗽𝗮𝗰𝗲 Wherever possible and appropriate, encourage parties to explore differences through the informal space of conflict resolution. Here, the parties create their own solution and agreement. This enables the buy-in and engagement to create a workable and sustainable solution. 3️⃣ 𝗙𝗮𝗰𝗶𝗹𝗶𝘁𝗮𝘁𝗲𝗱 𝗱𝗶𝘀𝗰𝘂𝘀𝘀𝗶𝗼𝗻 𝗮𝗻𝗱 𝗺𝗲𝗱𝗶𝗮𝘁𝗶𝗼𝗻 Sometimes the parties feel that further communication is impossible, or they hit a wall in exploring the more challenging aspects of their conflict. Facilitated discussions and mediation can be effective in unblocking barriers to resolution. Even formal conflict resolution processes, with the agreement of all key stakeholders, can be adjourned to explore this opportunity. In our experience, these methods are highly effective and enable dialogue to flow toward resolution. 4️⃣ 𝗥𝗲𝗰𝗼𝗴𝗻𝗶𝘀𝗲 𝘁𝗵𝗮𝘁 𝗳𝗼𝗿 𝘀𝗼𝗺𝗲 𝗰𝗮𝘀𝗲𝘀, 𝗳𝗼𝗿𝗺𝗮𝗹 𝗰𝗼𝗻𝗳𝗹𝗶𝗰𝘁 𝗿𝗲𝘀𝗼𝗹𝘂𝘁𝗶𝗼𝗻 𝗽𝗿𝗼𝗰𝗲𝘀𝘀𝗲𝘀 𝗮𝗿𝗲 𝘂𝗻𝗮𝘃𝗼𝗶𝗱𝗮𝗯𝗹𝗲 At Vista, we are passionate about supporting leaders and managers to resolve conflict within the informal space.     📅 On 26th October 2024, employers will be obliged to take ‘reasonable steps’ to protect workers from harassment of a sexual nature (‘sexual harassment’). 📝 Draft guidance from the Equality & Human Rights Commission (‘EHRC’) illustrates the new preventative duty to anticipate scenarios that may give rise to sexual harassment and take reasonable pro-active steps to address them (i.e. risk assess & act).     Recent Case Law has highlighted the importance of early consultation during a redundancy process. Two cases in particular are: 1️⃣ Joseph de Bank Haycocks v ADP RPO UK Limited The Employment Appeal Tribunal (EAT) ruled that the Claimant’s dismissal was unfair due to insufficient consultation at the early stages of redundancy. Notably, the EAT emphasized that an appeal cannot correct a lack of consultation during the formative stages. 2️⃣ Valimulla v Al-Khair Foundation In this case, the EAT overturned a Tribunal's decision, finding the Claimant’s dismissal procedurally unfair. The Claimant, placed in a pool of one despite others holding the same position, had not been consulted on the pool used in the redundancy process. The EAT stressed that consultation must occur when it can still influence the outcome.
