Taxpayer wins big in SDLT mixed use case! Head of Tax Andrew Sneddon and Partner Alex Barnes discuss a rare defeat for HM Revenue & Customs in respect of Stamp Duty Land Tax (SDLT). The First-tier Tribunal has ruled in favour of the taxpayer in the case of Guerlain-Desai v Revenue & Customs Commissioners. The outcome? The taxpayer is entitled to recover £225,250 in SDLT on her house purchase. With the recent abolition of multiple dwellings relief, taxpayers may increasingly explore mixed-use rules to minimise SDLT liabilities.
