Dramatic changes aimed at reducing the flood of class action lawsuits in Israeli courts will reach the Knesset for a first reading this week. The amendments are designed to ease the burden on small and micro-business owners facing multimillion-shekel lawsuits. However, the Israel Bar Association and other key figures in the legal arena are less enthusiastic about some of the changes. Reports about Google’s $23B #acquisition of Israeli unicorn Wiz raise questions about ongoing US legal proceedings against Wiz. In July 2023, Israeli cybersecurity company Orca Security sued Wiz for alleged #patent_infringement, demanding compensation and a ban on product sales. Could this lawsuit impact Wiz’s deal with Google?   Yoav Alkalay, Chair of our IL STEM Patent Practice Group, sheds light on this unique setting for acquisition in a recent Globes article. Our client, Maccabi Health care Services, petitioned the Tel Aviv Administrative Court to disqualify Leumit Healthcare Services from winning the Ministry of Defense tender for providing laboratory services to IDF personnel. Maccabi argued that Leumit's tender proposal was wrongfully amended after the final date of proposal submissions, and should have been disqualified. The court accepted Maccabi's arguments, identified substantial defects in the proposal, and stated that the amendment was "unreasonable" and "caused significant harm to the principles of tender laws, including equality". As a result, the court declared Maccabi the winner of the tender.
