Managing IP magazine was founded in 1990. It published its first legal directory (World IP Contacts Handbook) in 1994. The directory evolved over the years and was rebranded in 2013 as IP STARS. The research for IP STARS covers a variety of IP practice areas and more than 70 jurisdictions, making it the most comprehensive and widely respected IP guide in the legal profession. Did you ever wonder what all those IP lawyers are actually doing at INTA? Well, they attend educational sessions, work on committee workshops, meet with their international clients and associates, share the latest insights on trends and best practices, develop new business opportunities and generally do everything to advance the trademark law and practice. And yes, they also DO party! I normally do not share this kind of footage, but this one here I thought was too nice to remain unshared. Check out our performance of "Midnight Train To Georgia" with The Opposition™ , featuring the one and only Luna M. Samman of Arent Fox on lead vocals! Her band included Joe Simone of East IP on bass, Nathan Piché of Gowling WLG on guitar, and our incredible horns section (John Cheek, Mark Kaufman, Jussi Mikkola, Tom Vanderbloemen and Matthew Kendall). Backing vocals as well as somewhat clumsy Motown-style dance moves were provided by Jason Blair of Smith Gambrell Russell and by my humble self. Breaking: The USPTO has just released a notice about a tech incident that happened between February 5, 2024, and March 29, 2024. According to the notice, the Office "inadvertently published non-public patent application titles and numbers that could be viewed during the recordation process by unauthorized individuals with access to registered Assignment Center accounts." The Office notified all impacted applicants about this incident, which has been fixed. To reassure the applicants, the Office noted: "Any improper access of the application information between the dates of February 5, 2024 and March 29, 2024, is not considered a publication of such applications under 35 U.S.C. 122(b). No rights in United States patents are threatened by this limited access to unpublished patent application information. While it is unlikely that the title could disclose the invention in a way that would constitute patent-defeating prior art in any jurisdiction, to the extent any issue is raised, the USPTO will assist applicants by confirming that the disclosure was erroneous and inadvertent." The UK Supreme Court this week handed down its judgment in Lifestyle Equities v Ahmed, a trade mark infringement dispute about whether company directors can be held jointly liable for their company's infringing acts. After reviewing several authorities (some of which they disagreed with), the Justices clarified the law on accessory liability and allowed the appeal by the Ahmeds because there was no finding that they "had knowledge of (or turned a blind eye to) the facts which made the use of the "Santa Monica Polo Club" signs by Hornby Street infringements of Lifestyle's trade marks". The Justices, however, emphasised that company law does not provide "any support for shielding directors from personal liability in tort". This judgment will also have an impact on tort liability cases against directors or other company employees in other areas of law. The judgment also dealt with an account of profits in IP cases, again disagreeing with the Court of Appeal that the directors' salaries can be treated as profits made from the company's infringements. Although officially retired, we expected to see Lord Kitchin's name in this judgment and expect the same in the upcoming SkyKick judgment. Kitchin is now on the court's supplementary panel https://lnkd.in/e7Gg3YZi, which is good news for IP cases in the next few years. Austrian patent attorney firm litigates UPC infringement cases as lead counsel, not requiring attorneys-at-law Torggler Hofmann's Markus Gangl and Florian Robl are "outliers" -- but so far the results support the idea that patent attorneys who are qualified as UPC representatives can get good results for plaintiffs as well as for defendants. Deep-pocketed litigants are going to continue to hire interdisciplinary teams, but for many others, this option makes more sense than sending attorneys at law without patent attorneys who bring deep technical expertise to the table. https://lnkd.in/gPyE4tp2
