    Free speech lawyer, Matthew Gill joins Good Law Practice    This week, we are thrilled to have been joined by Matthew Gill, a defamation law specialist, to expand our work advocating for activists, defending freedom of speech and countering strategic lawsuits against public participation (SLAPPs). We use defamation law to contribute to the protection of civil society’s ability to speak truth to power and demand accountability.    Matt advises journalists, charities, NGOs, and individuals on the legal risks of publishing articles, reports, blogs, books, video and audio content prior to publication. He also advises on the legal disputes that can arise after the publication of allegations.     Issues on which Matt regularly gives advice include defamation, privacy, contempt of court, copyright, and breach of contract.     Matt previously worked in the media disputes teams at Wiggin and Howard Kennedy before joining us in July 2024.    As a result of funding from the Doogood Foundation, Matt will be able to offer pro bono and low-cost advice on defamation and media law issues to those who would otherwise be unable to defend their right to freedom of speech.  https://lnkd.in/dqccm-Un

    SUPREME COURT WIN! Delighted to share that a landmark judment in the Supreme Court has today removed the block on private law actions in nuisance and trespass where water companies pollute our waters with sewage. This appeal forms part of long-running litigation about sewage discharges into the Manchester Ship Canal. This is a massive win for all those, like us, fighting sewage dumping - because it opens the door for more types of legal action to be taken against water companies to hold them to account. The Supreme Court has ruled unanimously that the operators of the Manchester Ship Canal can bring a claim against United Utilities, the local water company, over unauthorised discharges of sewage even if there has been no negligence or deliberate misconduct. The decision overturns the High Court and Court of Appeal rulings that no such cause of action was available under the Water Industry Act 1991, which privatised the water sector and created the statutory scheme for regulating sewerage. Good Law Project previously intervened in the Court of Appeal (where the case didn't succeed) and then, at Manchester Ship Canal's request, released our counsel team to act for it. And we decided the case was so significant that we would keep going and partner with Environmental Law Foundation to bring a new intervention in this appeal - which has today succeeded. As Lord Reed said during the hearing to United Utilities: "your business model is based on breaching statutory duties. That is an inevitable part of the way you carry out your business, you tell us. Not only is the court meant to tolerate this, but those who suffer loss as a result of unauthorised behaviour contrary... to a statutory duty are meant to grin and bear it." As a result of today's judgment, no longer will we have to accept it. This judgment has wider implications beyond Manchester Ship Canal and United Utilities. Good Law Project - and no doubt many others - will now be looking for ways this judgment can help to clean up the mess made by water companies pursuing profit over people and planet.     Very excited to announce the launch of THE WATERSHED POLLUTION MAP! It reveals a huge range of potential pollution sources that can harm rivers, lakes, groundwater, coasts and more. It shows: river, lake and groundwater health | bathing water health | damaged and protected waters | sewage dumping | chemical pollution | urban and road pollution | substances being discharged into waters | years of Environment Agency sampling results | intensive pig and chicken farms | intensity of cattle farming | landfills, waste sites and contaminated land | big industrial sites | political constituencies for 2024 and 2019 | flood risk | economic deprivation and much more CLICK TO VIEW: https://bit.ly/4blhWNa As part of our investigations, we collect a lot of data from field research, from FOI/EIRs and from available official sources. We wanted to collate it, sort it and make it easily accessible so that as many people as possible can see the wide range of pollution and other environmental pressures taking place in their backyards, so they can better understand the challenges and perhaps even take steps to help improve it. It contains more than 100 datasets, ranging from river health, bathing water health, to historic landfill sites, sewage dumping, intensive farming, heavy industry and a lot more. While it's not going to show you any direct causation between a potential polluter and failing water body, it's fascinating to see what our rivers, seas, wildlife and habitats are dealing with and it begs further investigation. As journalists, the temptation is to hoard information until you're ready to break a big story but nature in the UK is in crisis so we decided to to arm as many people as possible -- other journalists, campaigners, communities, scientists, policymakers, regulators, lawyers and more -- with as much open source data as we can. We'll keep adding to the map and we'll update existing datasets once a year, where updates are available. If you have any ideas about datasets we should add, please get in touch and let us know how we can access them. Watershed gains nothing from releasing this map. Of course it will attract traffic to our website but that is not among our priorities. We remain committed to high quality environmental investigative journalism for existing mainstream media outlets.  If you use data from the map, we would be grateful if you could mention it somewhere in your work, so we can track the impact it is having and know it was worth all the effort, but that of course is not obligatory and the main thing is that it is used and it is helpful. The consequence will be that environmental regulators will need to start monitoring water quality and, if standards are not met, put in place measures to meet them. The pre-action letter alleged that the Welsh Ministers had misunderstood the statutory tests to be applied under the Bathing Standards Regulations 2013.     We are really pleased to have worked with Friends of the River Wye in successfully challenging the Welsh Government's refusal to designate The Warren in Hay-on-Wye as a bathing site. As FORW say this means that "Natural Resources Wales, will now be obliged to monitor water quality at the Warren between May and September, to publish the results, and to take steps to improve that quality if it is poor."
