    What is a cap on liability clause? A cap on liability clause is exactly what it says, it limits the amount that a party is liable for in the event of a contractual breach or for the negligence listed under this clause. As these clauses are used to limit your contractual risk, cap on liability clauses are usually one of the most heavily negotiated clauses. You can freely negotiate that cap with the other party; however, we suggest that the maximum amount of liability is no more than the value of your assignment and to always check that your insurance can cover that amount.     Last week, APSCo hosted its latest International Forum at La Fosse's London HQ, focusing on offshoring and outsourcing. The discussions highlighted cost savings and access to talent as key benefits, while also emphasising the importance of demographics, process, planning, and internal communication as critical success factors. Alan Craig from QX Global Group illuminated the advantages of outsourcing to India, demonstrating how businesses can achieve cost savings of around 40%. He described outsourcing to India as a “game changer,” noting the significant difference in age demographics compared to many Western economies—a crucial factor given the ageing populations in the West and succession planning. Stephen Shorter, Group CEO at Cobalt Recruitment & APSCo International Forum Co-chair: “It was fascinating to discuss the strategic and competitive advantages for recruitment businesses of offshoring and outsourcing. One of my key takeaways was that access to talent is as much of a benefit as cost arbitrage, and given the demographic trends, particularly in Western Europe, this is a topic that will be appearing increasingly on-board agendas in the near future.” Panellist and APSCo member, Keith W., CFO at Venn Group, highlighted the importance of treating your outsource staff as members of your own team and the importance of “getting your house in order”.     Labour's win marks a significant shift for the professional staffing sector. As Tania Bowers highlights, the UK's dynamic market must tackle the 'productivity conundrum' and leverage skilled contracting to drive growth. However, Labour's Employment Rights Bill introduces new regulations that could challenge the sector, especially regarding zero-hours contracts and day one rights. Despite IR35 remaining unchanged, Labour's commitment to defining genuine self-employment offers a glimmer of hope for contractors. The new Fair Work Agency could streamline dispute resolutions and enforcement. Recruiters and end-users might face higher costs but also gain economic certainty under Labour's clear majority. Technological advancements and upskilling initiatives are crucial as Labour aims to address the talent shortage and expand AI in public services.
