In a potentially seismic development, a federal district court in Florida held that the False Claims Act's qui tam provisions violate the Constitution's Appointments Clause—a ruling that, if upheld, would upend the landscape of FCA litigation. The Mexican Senate recently approved a bill that would amend the constitution to provide for the democratic election of judges. The reforms and other incoming bills create a high degree of uncertainty surrounding Mexico's future investments.
