In a much-anticipated ruling, the New Zealand Court of Appeal released their decision on Benjamin Brian Francis and Simon Dalton, as liquidators of Podular Housing Systems Limited (in liquidation) v Ilan Gross And Ors, which has provided clarity on the issue of equitable liens. RITANZ was asked by the Court of Appeal to provide submissions on the issues. Rachel Pinny, RITANZ Board Member and Wellington Barrister made the submission on behalf of RITANZ. I’m excited to be presenting a RITANZ talk in Auckland on Wednesday next week (14 August) on ADR in the Restructuring & Insolvency context – recent trends and developments. And I’m looking forward to the hospitality of our friends and hosts, Leon Bowker and the team at KPMG. The various forms of ADR (arbitration; mediation; adjudication; expert determination) each have their uses and pitfalls especially in a restructuring and insolvency context. Mediation has been a helpful process in solving some of our largest insolvency-related claims, but ADR clauses and Farm Debt Mediation requirements can equally be a challenge in the early stages of insolvency.  Since #ADR tends to be a confidential process, I’m looking forward to senior practitioners attending to share their views on how ADR processes have helped or hindered their work, and what they have taken from that engagement.
