🆕 📜 Today, the Center for International Environmental Law (CIEL) together with ClientEarth, Pacific Islands Students Fighting Climate Change and World's Youth for Climate Justice (WYCJ), published key takeaways from the climate advisory opinion (AO) recently issued by the International Tribunal for the Law of the Sea/Tribunal international du droit de la mer (ITLOS). Our short joint legal memorandum focuses on relevant aspects of the ITLOS AO for the ongoing climate advisory proceedings before the International Court of Justice (ICJ), particularly for the comments period and upcoming hearings. With special thanks to Lea Main-Klingst, Sophie Marjanac, Francesco Maletto, Aditi S., Theresa Amor-Jürgenssen, Vishal Prasad & Siosiua Veikune. 📖 Our joint takeaways consider pertinent cross-cutting issues, including, inter alia: 🔹 Applicable law 🔹 Best Available Science 🔹 Equity 🔹 Due Diligence 🔹 Duty Not to Cause Transboundary Harm 🔹 Adopting a Precautionary Approach 🌎 ⚖ With ITLOS having handed down its climate advisory opinion in May this year, and the Inter-American Court of Human Rights shortly after having concluded oral hearings in the ongoing climate advisory proceedings before it, our attention is now turning to the ICJ, where participants’ second round of written submissions are due on August 15th. Our joint memorandum on the ITLOS AO aims to support strengthening progressive legal positions in the #ICJAO4Climate. #AOLetsGO #ClimateJusticeAtTheICJ 👉🏽 Read more: https://lnkd.in/ehDiQjm7 📑 For a short overarching summary of the ITLOS AO, check out the CIEL blog co-written with the brilliant Upasana Khatri (link in the first comment below).

Thank you to Justice Dr. Ananda Mohan Bhattarai, Justice at the Supreme Court of Nepal, and Prof. Kokila Konasinghe, Head of the Department of Public and International Law at the Faculty of Law, University of Colombo, for your invaluable support to WYCJ's Asian front.
🌟Words of Appreciation for WYCJ Team🌟 Justice Dr. Ananda Mohan Bhattarai is a justice at the Supreme Court of Nepal. According to him, the initiative of the global youth to take climate change to the ICJ is an incredible move forward. They have asked the World Court to identify the obligations of states in our collective fight against climate change. The world is now in the hands of these young and capable climate activists and we must support them in whichever way we can. If we can do that, greater things will follow- this is only the beginning! Prof. Kokila Konasinghe is the Head of Department of Public and International Law, at the Faculty of Law University of Colombo. She is also serving as the Director of CELP at the University of Colombo. Fighting for an Advisory Opinion from the ICJ, in Professors opinion, is an innovative way of going ahead with climate justice. She also emphasises that inter generational equity in climate battle will be achieved, only if present and future generations equally toil towards a common goal. 🌍Be the Change: Join the movement using the link in our bio! Your voice matters. Together, we can shape a world where justice prevails and our planet thrives. #AOLetsGO #OurFutureOurRights #icjao4climate #ICJAO
