This was aimed at reviewing the provisions of the Bill, collating views, and drafting the memorandum that will be submitted ahead of tomorrow’s deadline. The proposal seeks to create a framework that defines and prescribes conditions to be met for government arms, institutions, and agencies to conduct public participation efficiently, meaningfully and inclusively.
Leading the review of the Bill, our programmes officer, Grace Naiserian, highlighted previous public participation legislations that have attempted to breathe life into Articles 10 & 118 of the Constitution.
In this Bill, Grace highlighted:
✔️ Roles of the Responsible Authority that varies by public institutions
✔️ General guidelines for public participation
✔️ Drawbacks of the Bill and
✔️ Consequences of the Bill
While collating views, participants addressed the provisions in the Bill’s clauses, drawing from previous court pronouncements on public participation, local and global best practices, and the Kenyan context of civic education and engagement.
The Bill, if assented into law, would form the basis on the national legal framework on public participation in Kenya and address pertinent issues on meaningful involvement of citizens, especially in the process of enactment of laws in Kenya. The deadline for submission of views on the bill is tomorrow, 30th October 2024.
