💡 SERVICES HIGHLIGHT: Textile EPR Services Are you aware of your obligations for Textile recycling? 🤔 ℹ In July 2023, the European Commission proposed extended producer responsibilities (EPR) for Textiles as part of the revision to the Waste Framework Directive. This means that any company manufacturing or importing Textile products into the EU could be responsible for financing the correct processes for the recycling and disposal of textile waste in the affected countries. 👕 The Netherlands is the latest country to put textile legislation in place and our new compliance scheme, ERP Netherlands, was set up to help producers comply with the new legislation. 📢 EU REGULATORY UPDATE: On October 14th, the EU Council adopted a regulation on the classification, labelling, and packaging of chemical substances (CLP). The new legal act introduces the significant changes to the CLP Regulation. The amendments include: 🔹 introduction of new hazards classes (endocrine disruptors and the long-life effect of certain substances) 🔹 establishment of classification rules for More than One Constituent Substances’ (MOCS) 🔹 clarification on labelling chemical substances and introduction of new digital labelling 🔹 adaptation of different forms of trade (online trade and bulk sales at refill stations) 📜 Once signed by the President of the European Parliament and the President of the Council, the new CLP regulation will be published in the Official Journal of the European Union and will enter into force three days later. 🔗 A link to the press announcement from the Council can be found with this post. ℹ To determine how these changes may or may not impact you, please reach out to H2 Compliance at [email protected]. ----------- [PL Version] 📢 14 października Rada UE przyjęła rozporządzenie w sprawie klasyfikacji, oznakowania i pakowania substancji chemicznych (CLP). 📢 REGULATORY UPDATE: The New EU Battery Regulation (entered into force 17 August 2023). 📅 The Battery Regulation has started gradually repealing the Battery Directive. The first implementation deadline regarding wider substances (Hg, Pb, and Cd) restrictions was in August 2024. 📑 The legislation has addressed deficiencies of the previous Directive and has widened its scope by introducing new battery definitions such as electric vehicle (EV), and light means of transport (LMT) batteries. 💡 This legislation provides a framework for commission-issued Implementing and Delegated Acts which will provide specific provisions’ scope, timeline, and method of implementation. Thus, it is not advisable for the producers to start taking measures for all requirements while details are still to be determined. 🔋 As a Regulation, the new legislation is applicable directly in all EU Member States, harmonizing the battery requirements across the European Union. However, for several articles such as infringement and penalty processes, national measures are required. 📜 The provisions will affect the whole battery lifecycle from its design to its end-of-life treatment. 📢 REGULATORY UPDATE: Proposal for a revision of EU legislation on Packaging and Packaging Waste. 📅 The new Packaging Regulation is expected to be published by the end of 2024. The new framework will repeal the Packaging Directive 18 months after its entry into force. 📦 As a Regulation, the new legislation will be applicable directly in all EU Member States, harmonizing the packaging requirements across the European Union. 📜 The provisions will affect the whole lifecycle of the packaging from its design to its end-of-life treatment. New requirements will include but will not be limited to: ◾ The Digital Product Passport (DPP) - The DPP will provide information on the packaging properties through a digital carrier (QR code) for both end-users and competent authorities. ◾ Labelling ◾ The packaging will carry instructions regarding its manufacturer and importer, reusability, and environmental sound disposal. ◾ Packaging recyclability ◾ The packaging recyclability will be measured in Recyclability Grades. 📢 REGULATORY UPDATE: California reporting deadline for expanded polystyrene (EPS) product producers is set for January 1st 2025 ♻ CalRecycle recently issued a reminder that Producers of EPS packaging and food service ware will have until 1 January 2025 to demonstrate compliance with SB54 (The Plastic Pollution Prevention and Packaging Producer Responsibility Act). It requires reporting for recycling rates of not less than 25 percent. 🚫 Producers who do not comply will not be able to sell, offer for sale, distribute, or import EPS products in or into California. 📈 EPS reporting requirements for recycling rates will increase in the future as follows: • Not less than 30 percent on and after January 1, 2028 • Not less than 50 percent on and after January 1, 2030. • Not less than 65 percent on and after January 1, 2032 📄 As per SB54, the reporting / demonstrating of compliance with EPS recycling rates is not something a producer responsible origanization (PRO) is required to do.
