Korshunova et al. proposed an approach based on a convolution neural network (CNN) that transferred semantic content, e.g., face pose, facial expression😃 😎 🙂 😋 and lighting conditions, from the input image to create the same effects in another image. They introduced a loss function that was a weighted combination of style loss, content loss, light loss and total variation regularization. 🔍 Exploring GDPR and AI: Insights from France's Recent Guidance On April 8, 2024, the French Data Protection Authority released guidelines on the application of GDPR to AI systems. As India anticipates clear enforcement rules under the DPDPA, the insights from the guidelines offer valuable lessons, though they must be contextualised to the Indian context. The French Guidance Approach: The guidelines break down AI system functions into two phases for GDPR compliance: Development Stage: Designing, development, and training of the AI system. Deployment Stage: Putting the developed AI system into use. 📋 Distinct Compliance Needs: Each phase consists of different processing operations, requiring separate analysis for GDPR compliance, particularly for identifying legal bases, informing individuals, minimizing data collection, and defining retention periods. Therefore, the compliance of AI systems with GDPR must be assessed meticulously at both stages, as the applicable legal regime and obligations may differ. Defining the Purpose of Processing: The guidance emphasizes defining a clear and explicit purpose of processing at the development stage, crucial for both compliance and operational clarity. The relevance of the guidance on purpose of processing can be directly mapped to India’s DPDPA as it also requires Data Fiduciaries to inform the Data Principles of the purpose for which their personal data is proposed to be processed, while obtaining their consent for processing. The following two industry specific case scenarios offer useful guidance: Case 1: For AI systems with a predetermined operational use or uses, the purpose is defined early in the development phase, ensuring clarity and legitimacy throughout its lifecycle. Case 2: For general-purpose AI systems and foundational models, where operational use is unspecified and the AI System can be used for a wide variety of applications, the guidelines suggest outlining the system type in a sufficiently clear and intelligible manner and its technically feasible functionalities and capabilities that the data controller can reasonably foresee from the development phase, aiding the future application alignment while also ensuring that the principle of finality is respected. 💡Other Useful Insights: The Guidance also shares insights on other useful aspects of GDPR enforcement on AI Systems such as on determining the applicable legal regime, role of different actors involved in an AI System as data controllers and most importantly, the data protection considerations in system designing.
