We have bolstered our corporate restructuring, insolvency and commercial litigation practice, and continued our fast-growing Asia Pacific offering with the hire of a team led by partners Paul Jaco Buitendag and Rena Solomonidis in Melbourne. Paul and Rena have acted in several of Australia's largest corporate collapses and specialise in complex multi-jurisdictional insolvencies, corporate restructuring, regulatory investigations and commercial disputes. The International Civil Aviation Organization introduced the Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA) with the intention that aircraft operators monitor their emissions and offset excess emissions arising from covered aviation activity. The first phase of CORSIA has started. This briefing by HFW's sector focused aviation practice discusses the challenges aircraft operators face in complying with their obligations under the first phase of CORSIA. It explores CORSIA eligible fuels (CEFs) and details how they can be used to satisfy aircraft operators' offsetting obligations. The challenge for aircraft operators in managing their CORSIA compliance involves using one or more of CEF and CORSIA eligible emission units (CEEUs). However, the choice of using CEFs, in particular the tensions between availability and price, is presently not a simple one. Cost issues lead to questions of competitiveness and supply issues lead to questions about whether an aircraft operator needs to do anything at all just now. In the recent case of Tesseract International Pty Ltd v Pascale Construction Pty Ltd, the Australian High Court ruled that proportionate liability laws do apply to arbitration. The proportionate liability regime allows the courts to divide responsibility among multiple wrongdoers based on their share of the loss and damage suffered by the plaintiff.
