- There is zero discussion of this image in the article. However, the text you quoted ("sitting in a meadow of flower") provides an adequate replacement of the image, proving that the image is replaceable fair use and thus violating WP:NFCC#1. You have to show that removal of the image would be detrimental to the understanding of the article (see WP:NFCC#8). - Why is it necessary for the article? It is easily replaceable by text: "A man is standing in front of a wall with some graffiti on each side of him." - The item §7 you referred to says,
- "A photo from a press or photo agency (e.g., AP, Corbis or Getty Images), unless the photo itself is the subject of sourced commentary in the article."
- CNN is a commercial news company but doesn't appear to be a press or photo agency when comparing it with the three examples and looking at the definition at Press agency and news agency. So item §7 apparently doesn't apply to CNN.
- Anyhow, the current image that was uploaded yesterday was not sourced from CNN. See the source url of the recent upload in the File history at comment section of the current version, i.e. http://names.911memorial.org/#lang=en_US&page=person&id=4946 .
- BTW, I just noticed that the same picture (uncropped) is on the Facebook page of the deceased Hamdani, if that's of any relevance.

- It looks like that to me. Also, it looks like CNN and the 9/11 site both got the image from Hamdani's Facebook page by cropping the image there, as I alluded to in my previous message, and for some reason CNN's was distorted and the 9/11 website's wasn't. - WP:NFCC#4 says,
- " Previous publication. Non-free content must have been published or publicly displayed outside Wikipedia."
- Whether or not it is non-free content, it has been publicly displayed at each of the three sources previously mentioned before it was uploaded to Wikipedia yesterday. So the image complies with this section 4.
- And WP:NFCC#10a says,
- "Identification of the source of the material, supplemented, where possible, with information about the artist, publisher and copyright holder; this is to help determine the material's potential market value. See: Wikipedia:Citing sources#Multimedia."
- Supplementing with that info isn't reasonably possible since it isn't given with the image that appears at any of the three sources. Also, it doesn't look like there is any potential market value for the image, which is the main consideration of the policy. So the image complies with this section 10a.
- Of the three images, CNN, 9/11 website, and the more complete one on Facebook, my preference is to use the one from Facebook.[1] Would that be OK?

It's not "blatant" at all. In fact it meets all 10 of the NFCC criteria. Stefan2 has so far been singularly unable to come up with a coherent reason why this shouldn't be considered fair use. Its the only image available, and it greatly improves the reader's understanding of the page, and the origin of the image is clearly marked.
I made a request to Stefan2 to assist me in correctly documenting the licensing and fair use request, but this has been refused.

- Delete: image licencing decidedly odd. Photograph would have a separate copyright requirement, and there's no indication that's met. It's given as CC-BY-SA presumably, but it's a very small size for a typical photograph by an uploader.
