The result of the discussion was: Delete - The Bushranger's argument seems to be that BB was de minimis in this screenshot, which he was not. Another screenshot from this work which does not contain Bugs Bunny would in fact not be copyrighted. Magog the Ogre (talk) (contribs) 02:27, 31 July 2012 (UTC)[reply]
- Derivative work of A Wild Hare (1940, R434265). Cf. Commons:Commons:Deletion requests/Image:Mickey Mouse.jpg. Stefan2 (talk) 00:05, 15 June 2012 (UTC)[reply]
- Wrong. It's from another cartoon, Falling Hare, which is in the public domain. ←Baseball Bugs What's up, Doc? carrots→ 01:18, 15 June 2012 (UTC)[reply]
- All illustrations of Bugs Bunny are derivative works of A Wild Hare. No illustration of Bugs Bunny enters the public domain before A Wild Hare enters the public domain. It is thus sufficient to prove that the film A Wild Hare is copyrighted. See the mentioned Mickey Mouse deletion request. --Stefan2 (talk) 01:25, 15 June 2012 (UTC)[reply]
- You don't know what you're talking about. Falling Hare is in the public domain. ←Baseball Bugs What's up, Doc? carrots→ 01:36, 15 June 2012 (UTC)[reply]
- You have apparently still not read the deletion request I linked to. All illustrations of Bugs Bunny are copyrighted and they will remain so at least until the film A Wild Hare enters the public domain since all illustrations of Bugs Bunny are derivative works of the film A Wild Hare. However, if you edit the film Falling Hare by removing all pictures of Bugs Bunny and other recurring characters, you get something which is truly PD. --Stefan2 (talk) 02:03, 15 June 2012 (UTC)[reply]
- You're making this stuff up. That image was uploaded like 6 years ago, and the issue was settled then. According to the upload note, Falling Hare's copyright was not renewed, and it became public domain. ←Baseball Bugs What's up, Doc? carrots→ 02:07, 15 June 2012 (UTC)[reply]
- As I wrote, read the deletion request I linked to, and then go to Commons and read dozens of similar deletion requests. After that, also read List of films in the public domain in the United States#Copyrightable elements of a film --Stefan2 (talk) 02:24, 15 June 2012 (UTC)[reply]
- It was OK 6 years ago, and it still is. You're inventing this stuff. ←Baseball Bugs What's up, Doc? carrots→ 02:28, 15 June 2012 (UTC)[reply]

- Why are you refusing to read the pages I have linked to? --Stefan2 (talk) 02:45, 15 June 2012 (UTC)[reply]

- Keep - "Falling Hare" is in the public domain. Any screenshots from "Falling Hare" are also in the public domain. It is not a representation of Bugs Bunny, which would be copyrighted, but a screenshot of "Falling Hare", which is not copyrighted. Depictions of the character are copyrighted, as is the character itself, unless they are direct, unaltered images taken from the PD material itself - which is what this is. - The Bushranger One ping only 02:26, 15 June 2012 (UTC)[reply]

- Keep "Falling Hare is public domain while "A Wild Hare" is not. They are different things. Obtund 22:24, 15 June 2012 (UTC)[reply]
- Why are you all refusing to read the links I provided? Why does this article state that a man had to pay a $500,000 fine for distributing copies of The Mad Doctor (1933 film) if it doesn't have to do with the copyright renewal of the film Steamboat Willie? --Stefan2 (talk) 22:49, 15 June 2012 (UTC)[reply]
- Because (1) Bugs Bunny is not Mickey Mouse; (2) "Falling Hare" is public domain; and therefore (3) your alleged arguments are bogus. ←Baseball Bugs What's up, Doc? carrots→ 22:52, 15 June 2012 (UTC)[reply]
- Yeah he got that fine because it was a film and covered by the FBI. This is different, this is an image, and it is completely different from "A Wild Hare," as if they were the same they would under the same name, or subname. It is like saying twins are the same people, they look the same but they are not the same people. ObtundTalk 23:27, 15 June 2012 (UTC)[reply]
- Hm? No, it says that the man was selling single screenshots from the Mickey Mouse film. This is an identical situation, except that it is Bugs Bunny instead of Mickey Mouse. --Stefan2 (talk) 12:59, 17 June 2012 (UTC)[reply]
- "Selling?" What is wikipedia "selling"? ←Baseball Bugs What's up, Doc? carrots→ 14:45, 17 June 2012 (UTC)[reply]
- See wmf:Resolution:Licensing policy: "Free Content License: A license which meets the terms of the Definition of Free Cultural Works specific to licenses, as can be found at http://freedomdefined.org/Definition version 1.0.". And according to Freedomdefined.org: "Essential freedoms: Copies may be sold, swapped or given away for free, as part of a larger work, a collection, or independently." --Stefan2 (talk) 14:55, 17 June 2012 (UTC)[reply]

- Why is this taking so long time? This is an obvious copyright violation. Just compare with similar deletion requests such as Commons:Commons:Deletion requests/File:Falling hare bugs.jpg, Commons:Commons:Deletion requests/File:Falling hare.jpg and Commons:Commons:Deletion requests/Files in Category:Fresh Hare (some from different Bugs Bunny films). --Stefan2 (talk) 12:58, 16 July 2012 (UTC)[reply]

- Note It is the image in "Commons" [2], of another person with the same name that should be looked into. The image in commons claims to have been self-taken which is unlikely. Tony the Marine (talk) 18:10, 15 June 2012 (UTC)[reply]
- If the 2000 publication was the first publication of the photo, then the photo is copyrighted until the end of 2047 or until 70 years after the photographer died, whichever is later. As I wrote, the template claims that the photo was published before 1923, but no pre-1923 publication has been listed. Taking a photo is not the same thing as publishing a photo. --Stefan2 (talk) 18:32, 15 June 2012 (UTC)[reply]
- It is unknown when the image was first published. It is the only known photo of the subject in question. The publication states thet the image was taken in 1911, therefore since copyright laws did not apply when the image was taken it is PD and the publication (a government publlication) and anyone else who may desire to publish it may do so. Such is the case for example when you come upon an image of Abraham Lincoln or Thomas Edison in a history book. Image of a historical person pre-1923. Tony the Marine (talk) 22:23, 15 June 2012 (UTC)[reply]
- Er, are you saying that there were no copyright laws in 1911? Haven't you heard of the Copyright Act of 1790? Of course there were copyrights in 1911! --Stefan2 (talk) 22:43, 15 June 2012 (UTC)[reply]
- Note It is the image in "Commons" [2], of another person with the same name that should be looked into. The image in commons claims to have been self-taken which is unlikely. Tony the Marine (talk) 18:10, 15 June 2012 (UTC)[reply]
- You know perfectly well what I am saying. We are talking about the copyright laws that apply to the United States. Puerto Rico has been a territory of the United States since 1898, way before the copyright laws of 1923 applied. This image has been used numerious times including in the "JOSE IGNACIO QUINTON - Obras Completas Aguinaldos Vol. 5". Tony the Marine (talk) 22:53, 15 June 2012 (UTC)[reply]
Comment - Another thing can be done. As an logical option instead of deleting the image, I could fix the file content and place a "fair use rationale". The image is only used in the subjects bio. to give a physical decription of the subject. Any thoughts? Tony the Marine (talk) 06:13, 16 June 2012 (UTC)[reply]

- Seems to be copyvio from here. However, Wikipedia's file is heavily cropped and still has more pixels than the other photo. Stefan2 (talk) 15:36, 15 June 2012 (UTC)[reply]
- It is not cropped at all! I do not know why you are so sure it was. I took this picture at the same time I took the picture you think it is cropped from (I do not think you were there at the time watching). When I loaded the photo I checked the "free" box. So what is wrong? I haven't uploaded any photos for a long time. Perhaps it is not worth the bother to do so. Jeffrey M Dean (talk) 16:27, 15 June 2012 (UTC)[reply]
- BTW, look at the photos you are comparing. The one on the bmwmoa forum has a lake in the background. The one I uploaded has saguaros in the background. Have you ever seen saguaros growing by a midwestern lake? Jeffrey M Dean (talk) 17:00, 15 June 2012 (UTC)[reply]
- Sorry, I've never been west of Glasgow — this seems to be further to the west. I don't know anything about the plants. However, the image indicated by Google ([3]) does seem to show the same vehicle and the same plants, so it seems to have been taken at the same location. If you uploaded the image to the forum, maybe you could do something to prove that both accounts belong to you? --Stefan2 (talk) 19:46, 15 June 2012 (UTC)[reply]
- How can I prove that I took the photos? The photo of the handsome man standing by the R68 further down on on my R68 web page ([4]) is me. You can see the saguaros behind me and in the photo I uploaded. I think that is pretty good evidence. (BTW, below is a photo I took and uploaded behind my Tucson house. Snow is very, very rare in Tucson.) My parents are deceased so they cannot vouch for me. My wife, Jill, could but you would have no more reason to believe her than me. Any advice you can offer I would welcome. Jeffrey M Dean

- Keep File:BMW R68 drive shaft.jpg is probably correctly licensed. I think these are two different photos. But in general, this type of problem is possible with any photos from Jeffery M Dean/JeffDean/BMWDean/etc. He has in the past uploaded photos in multiple locations with different licenses, like all rights reserved on a forum but CC-by-SA on a Wiki. Or uploaded them to Wikipedia but then complained over other users asserting their right to make derivative works -- though that issue has been put to rest. I probably shouldn't dredge up old, resolved disputes, but I'm only saying there's history here with regard to licenses confusion.
As far as I know, Mr. Dean at this time does fully understand what CC-by-SA means, and wouldn't abuse it. I'm not a lawyer though; in theory if you found an "all rights reserved" photo that was uploaded before one licensed here as CC-by-SA, maybe that could be a problem. In theory. But then again, WP:BEANS. --Dennis Bratland (talk) 23:40, 15 June 2012 (UTC)[reply]
- keep These are obviously two different photos. Look at the position of the cactus relative to the rear lamp.

- That's Roger Davis as he looked in the 1970s. Clearly it wasn't made in 2008. Uncle G (talk) 13:39, 16 June 2012 (UTC)[reply]
- I am the one who assembled most of this information AND posted this photo, IIRC, several years ago. What exactly is it you want, and why is it NOW an issue? This photo is most likely from Roger's "Alias Smith and Jones" era in the early 1970s, and certainly is out of the usual 26(?)-year copyright range, anyway, if it is indeed not of Roger's property. And the reference to 2008...where is this coming from? So no photo of RD is accepted if older than 2008? I'm sure RD can supply me with a 2008-era photo, but he's certainly not as recognizable now as he would be in a photo from the 1970s. For reference, I am Roger Davis' cousin and webmaster, Mike Shannon. See www.rogerdavisonline.com. Please advise so this can be resolved. user:shannon914 — Preceding unsigned comment added by 99.6.141.85 (talk) 01:02, 19 June 2012 (UTC)[reply]
- The uploader wasn't you, 99.6.141.85. It was CaseyRockStar (talk · contribs), and that person claimed that the image was made in 2008, by someone with the unlikely name of "BroncoBuff". That's a fairly obvious falsehood, given the picture. It's an issue now because it has always been an issue. It just hasn't been spotted until now. This is false copyright and authorship information. Uncle G (talk) 16:23, 19 June 2012 (UTC)[reply]
FWIW, I discovered the file after locating a PD image of Roger Davis which I uploaded to Commons as File:Roger Davis Alias Smith and Jones 1972.JPG. - Thanks for the info and explanation. Sorry, I'm not trying to be difficult. I will get with Roger in the meantime and see if he has any specific photos he absolutely owns that could be uploaded to Wiki. He may be OK with the one you located. And thanks for researching the origin of the posted photo...I believe I have the same one on rogerdavisonline.com and assumed I sent it along. Personally, while I respect people's copyrights, we have to put into question which values we have to uphold here, particularly in countries which are not as forthright as the Philippines with respect to these matters: adherence to the law, or the educative value of the works in question. I'm utterly surprised that people are willing to force people to choose which is more important.:| --Sky Harbor (talk) 06:29, 18 August 2012 (UTC)[reply]

- No freedom of panorama in the Philippines, see Commons:COM:FOP#Philippines. 1974 statue according to List of public art in Manila. Dead link to a government site listed as source. No evidence that the statue was made by the government, so the {{Non-free Philippines government}} notice presumably only applies to the photo copyright and not to the statue copyright. - Note: This image is currently tagged as non-free. If there is a dispute with the rationale, please tag the image with {{dfu}} or list it at WP:Non-free content review. AnomieBOT⚡ 08:04, 16 June 2012 (UTC)[reply]
- It is not tagged as non-free. It is tagged as a free photo (although it does have a fair use rationale). --Stefan2 (talk) 13:53, 16 June 2012 (UTC)[reply]

- Keep - The museum staff indicated the drawing was state sponsored and in the public domain. I took the photo and cleaned it up. I also emailed permissions-en@ with permission. Rackmount-guy (talk) 00:36, 16 June 2012 (UTC)[reply]
- In that case, you should tag the image with {{OTRS pending}} so that people know that an e-mail has been sent to OTRS. --Stefan2 (talk) 13:55, 16 June 2012 (UTC)[reply]
