Terms Of Service

I would like anyone who is willing to commission me to read these terms of service to ensure a successful, easy and fulfilling commissioning experience for you (the customer) and me (the artist).

Artwork Content

• For all transactions (excluding in person/event sales) you MUST be 18 years or older to order artwork.
• The artist will not create works in another artist’s style (this excludes special parody commissions).
• The artist is open to most subjects (including NSFW) but will NOT draw:

            - Minors in adult situations, Beastality, or other illegal/non consenting situations

- Scat,watersports, excessive fluids

- Hate art including negative stereotypes,fetishes, or any harmful depictions based on sexual orientation, race, gender identity, ect.

Artist has the right to accept or decline any commission request.

• For digital artwork the high resolution piece may be sent to the client. This must be requested before the artwork is started.
• Artist has all rights to the commissioned artwork. The client retains rights to their characters.
• Clients may NOT make profit from or distribute their commission (including character designs) unless an agreement was made with the artist. (more in the “Personal Usage and Distribution”

What Is Required From The Client

• A payment is required in full (or the first payment if on a payment plan before) the client’s commission is started.
• An exact and clear description of what the client wants, if artistic freedom is ok, and/or the completed commission form. If a client needs a RUSH ORDER (completed art due/guaranteed in 7 days or less) a RUSH FEE of 50% is required upfront.
• Please be patient and respectful. Please refrain from asking about the progress of a piece within a week (7 days) of the batch start date (stated at each opening) unless previously discussed or is of HIGH urgency. Please do not send frequent messages to social media or Telegram regarding the commission unless discussed.  Excessive failure to follow this and respect boundaries will lead to the artist blocking the client on social media until the piece is completed or permanently. Clients will be given a gentle reminder and warnings if this happens.

Payment Information 

•  Paypal/Cards through invoicing is accepted for all online commissions. Artwork commissioned in person is payable through PayPal, cash, or credit/debit cards.
• All payments are in USD.
• If the client makes a mistake with the payment the artist is not responsible.
• For commissions $100 and over payment plans are available and can be discussed with the client.
• Online orders will be paid via PayPal invoice sent by the artist. Payments MUST be made through this invoice system. Any payment sent outside of the invoice will be refunded asap. This may result in the order being canceled.
• All artwork is non refundable.
• Payments must be received within 48 hours unless another time was discussed with the artist. If no payment is received the clients slot will not be held to give others a fair chance.
• If a client would like their piece mailed they must pay the shipping fees calculated by the artist. (More on shipping in “Product Delivery”)

Personal Use and Distribution

• The client may re-post their commission(s) as long as credit is given to the artist via link. Credit must be given when posting or redistributing. Please do NOT upload or share any high res files without permission from the artist.
• Do NOT recolor or edit the artwork in any way. The client can not do edits OR commission someone else to do it. The artist is the only one able to do edits.
• Do NOT crop, alter, or remove any watermarks or signatures.
• Unless discussed the client may NOT use their artwork for sales purposes unless an agreement is made with the artist. If artwork is made for sales/licensing purpose additional fees may apply.
• Clients DO NOT have the right to mint or sell their commissioned artwork for NFT!
• Do NOT PRINT the artwork without the artist’s permission. This includes prints, stickers/decals, keychains, shirts, business cards ect.  (exceptions/acceptable forms are printing ref sheets, badges, and commissions for at home wall hanging)
• Character designs that will be used for promotional materials are considered “mascots” and require additional licensing fees. This includes designs that will be used for Youtube channels, Twitch or other streaming services, merchandise, charity, ect. Client must disclose this upfront or notify the artist if they wish to make the design into a mascot.
• Artist has the right to reuse any unused concepts and sketches from the commission process.

Product Delivery

• Artwork competition for smaller works 1-2 weeks.
• Artwork completion for larger works 1-4 weeks.
• For commissions $70 and up the client may request a W.I.P (work in progress) sketch. Commissions under this range will be completed without a W.I.P. Experimental pieces, icons, and most convention badges do NOT get W.I.Ps
• The client may request up to 2 simple edits for digital commissions in progress. Additional edits will cost additional depending on complexity.
• If there's an issue with the artist that can interfere with the commission work (illness, emergency, travel, ect) the artist will notify the client.
• If the client needs a piece shipped out to them they must have paid shipping and let the artist know at least 2 weeks before the due date.
• For shipped works the artist on NOT responsible for any lost, damaged, or stolen items.

The Client must read, understand and agree to this Terms Of Service before commissioning the artist. By sending the payment, the client agrees to all terms listed above.
