[edit]The Ayala Center complex was incepted in 1991, and fails COM:FOP Philippines. While there's now a pending bill to introduce FOP, the status as it stands today per IPOPHL -BCRR is "freedom of panorama is not provided in our copyright law". Regular rule applies: meaning permission from the architects of this complex is required to retain these freely-licensed images of the copyrighted architectural complex.

- Not all, @Jayjay2020: . While enwiki allows unfree buildings (like Burj Khalifa and GMA Network Center) via w:Template:FoP-USonly, Wikipedia is not supposed to imitate Commons as it is not a file repository. That's why there are only around 5 images of Burj Khalifa there. For public art like EDSA Shrine and People Power Monument, however, these are not buildings and cannot be hosted on enwiki except that a limited number of file shall be moved there and comply with w:Wikipedia:Non-free content. That is, reduce them to low quality and resolutions, and treat them as unfree images as derivatives of copyrighted artwork. Enwiki follows U.S. law, and applies US FOP (for buildings only) for all unfree buildings. But US has no FOP for public art, and therefore copyrighted Philippine sculptures must be submitted under fair use restrictions. Also, these should be used: unused fair use images of Philippine sculptures will get deleted after being orphaned for seven days. JWilz12345 (Talk|Contrib's.) 11:20, 18 February 2021 (UTC)

- @Jayjay2020: see also my failed attempt to undelete Patrickroque01's image of Bonifacio Shrine, Manila on enwiki at w:User talk:Fastily/Archive 6#Restoration of a deleted file, which made me realize that enwiki only accepts full-resolution images of unfree buildings, but not unfree sculptures and public art (complying with U.S. FOP and U.S. copyright law), unless one image of that public art will be used complying with w:Wikipedia:Non-free content#Guideline examples. - JWilz12345 My only problem here is that because of this FOP issue users like me will be prohibited from uploading some files that are restricted and subject to the Philippine laws about Intellectual Property and on public domain. Also, users like me need to ask permission from the architects or from the owners of the said user. There is no problem if the file photo is owned by the government but in the case of the file photos which were owned by private entities, there is a problem. What if I am aware on who is the architect or designer of the said thing but I don't know him or her personally. Jayjay2020 (talk) 14:11, 18 February 2021 (UTC)
- @Jayjay2020: that's why it is allowed to upload local images of unfree buildings on enwiki (though one should not upload 50 or 100 images of GMA Network Center building or SM Aura Premier there as enwiki is supposed to be encyclopedia and not a media file repository); you may want to search on enwiki with keyword incategory:"Wikipedia files not suitable for Commons" burj (there are only around 4 images of Burj Khalifa and a single, heavily-used image of Burj al-Arab hosted on enwiki). See also the third reason at w:Wikipedia:Moving files to Commons#Why move files to Commons?: "Wikipedia, by contrast, is not a file host and therefore does not permit unused files." This means while it is allowed to host unfree buildings there (using w:Template:FoP-USonly), it is not OK to host hundreds or even thousands of unused images of the same unfree building as Wikipedia is not a media repository in its essence. For sculptures and public monument still in copyright (like Bonifacio Shrine and People Power Monument), however, fair use will be applied as images containing unfree public art, and these will be reduced to lower resolutions and be compliant to w:Wikipedia:NFCC#Policy. Also pls. remember: Wikimedia Commons follows both copyright laws of U.S. and the works' country of origin, while English Wikipedia only follows U.S. copyright law (as such it accepts images of unfree buildings from no-FOP countries to some extent, but not unfree sculptures and monuments from such countries, except those sculpture/monument images complying with Wikipedia's guidelines on fair use content) With regards to pinging an admin, I feel that admins like King of Hearts can upload them locally under their same file names with little problems, as I cannot upload them locally due to the files having identically-named files here on Commons.
