Has been nominated for speedy deletion, but I believe we need some further discussion here. The reason given was While this allegedly is free use, in fact, the description translates to say "Photograph of a publicity portrait of singer Cher, just showing her face". This would qualify as a duplication of a copyrighted photo used for publicity at her Las Vegas show. Regardless that the photo was taken by someone releasing his photo, it is a reproduction and I believe the CC usage is invalid.. →Na·gy 16:28, 18 February 2009 (UTC)[reply]

  •  Comment The Flickr source [1] does not call it a publicity photograph. Scanning through the top images.google hits for Cher Las Vegas 2008, I didn't see a match, but saw several images that looked to be taken at the same day-- matching outfit & hairdo. I left a note on the Flickr photo page asking if the Flickr user took the photo themself. -- Infrogmation (talk) 04:03, 19 February 2009 (UTC)[reply]
    • I think the better question might be whether he took the actual photo of Cher herself, or was it taken of a poster/picture posted at the location. I didn't find multiple images in this outfit on image.google, but the ones I saw don't have the same quality as this, nor do the pictures the flickr uploader has posted have a polished and professional look to them as this one does. Everything else posted by the flickr user is of Tony Bennett and from experience I know that Cher doesn't discourage photos while she is working, but this has a professional portrait quality. Not that the flickr user doesn't take nice photos, but none of them have that quality. Meanwhile, images posted by other flickr users have similar photos, albeit not the exact one, but it indicates to me that there are likely others in the same wig and outfit which are professional. [2] [3] Also, the website for Caesar's Palace in Las Vegas has yet another similar professional photo in the same outfit and wig posted with the section on her show. [4] All of this casts even more doubt about the free-use assertion on this particular photo. If it is a picture of a picture, doesn't the copyright question come into play?
