Last week, EFAMA’s António Frade Correia spoke about withholding taxes and FASTER at a conference organized by EY Luxembourg, with fellow panellists Vilma Domenicucci and Lourdes Bustos. Big thank you to Rosheen Dries for hosting us. Some takeaways included: 🚀 The Launch of FASTER: The EU’s first legal instrument for a common withholding tax system is here, thanks to the collaborative efforts of the European Commission, Finance Ministers, Tax Authorities, and industry stakeholders like EFAMA. Now the focus will be on implementation of a Directive that hopefully will work in practice. 🔍 Focus on the short-term implementation, eyes on the future: The Directive remains flexible for registration, due diligence and reporting obligations of CFIs. A single ‘Relief at Source’ EU system should be the preferred option for all Member States and the Commission could expand the scope of this initiative in future. 🌐 National Implementation: The focus now shifts to how each Member State will adapt and implement the new rules. The costs for tax administrations and market participants remain uncertain, therefore engagement between the various entities will be pivotal for a cost-effective rollout. 🛠️ Implementation Roadmap: The Commission’s plan to roll out implementing acts (eventually administrative guidance) is underway, targeting areas like eTRCs, CFIs registration, due diligence, and reporting procedures. The focus is on practicality and precision, ensuring the Directive’s smooth integration into existing frameworks. It’s time to restart technical discussions.
