    I am incredibly proud of the next generation of super achievers in my family, so was thrilled when my nephew Joshua O'Neill recently completed his studies in Masters of Organisational Psychology from The University of Queensland 👏🏿🖤💛❤️ This is an area we need more of our mob working in to effect change particularly in workplaces where ‘unconscious bias’ and racism exist. On a personal note I have watched this young Neph grow up always respectful of his elders and proud to be Arrernte and Kayteye from the NT.     In our latest blog article, Mapien’s Head of Workplace Strategy - Southern Region, Jamie Paterson, delves into a recent case where the Federal Circuit Court ruled that an individual based in the Philippines and employed by an Australia company, was in fact a national system employee under Australian law. The case centres around the distinction between an employee and an independent contractor, and serves as an important reminder for Australian employers to ensure compliance with relevant employment laws, regardless of where the employee is located. In his overview Jamie provides insight into some key lessons Australian employees can take away from this case, and how failure to be compliant with relevant laws and regulations can result in costly legal consequences and reputational damage for companies operating in a globalised workforce.     Last week Mapien’s immigration team caught up in Brisbane for the Migration Institute of Australia National Conference. Mapien’s Chief Migration Agent Sarah Pettit had the honour of MC’ing the event, and sharing her insights, expertise (and some Halloween fun!) along with engaging and knowledgeable speakers and presenters. After an action-packed day one, which focused on Migration Law and Policy: Adapting to New Realities, our team headed to the Gala Dinner, to honour the achievements of colleagues and members of the MIA. On Day Two of the Conference, the Director of the Skilled Visa Program, Mr McDonald, provided updates on the new Skills in Demand Visa. He confirmed: ➡ Skills in Demand ✔️ 4 year visa ✔️ PR Pathway ✔️ Mobility between sponsors ✔️ Work experience reduced to 1 year ✔️ STSOL and MLTSSL will close to new applications late 2024 ✔️ The visa will still be a Subclass 482, but called Skills In Demand ➡ DOHA confirmed: ✔️ On the 23 November 2024, the work experience criteria required for the Subclass 482, TSS visa will be reduced from two years in the last five years to one year. ✔️ There will be three streams under the Skills in Demand Visa: Stream 1 – Specialist Skills – Highly skilled migrants, any occupation except trades workers, machinery operators, drivers and labourers, earning at least $135,000 per annum; Stream 2 – Core Skills – skilled employees for now and the future, new core skills occupation list to replace the skilled occupation list, core skills income threshold ($73,150 to $135,000); and Stream 3 – Labour Agreements – TSS Labour Agreement stream, will be renamed SID Labour Agreement stream, it will work in tandem with the specialist skills and core skills stream, this stream is currently under development. The conference provided a wonderful opportunity for our national immigration team to connect with each other, and with industry leaders, to share practical tips and advice and to discuss global migration programs. Leaders are experiencing increased complexity in conducting performance conversations – needing to apply IR knowledge, HR frameworks and account for psychosocial factors to navigate an already difficult interaction. During our workshop, participants explored practical strategies to strike the right balance between holding teams accountable, while also supporting their mental wellbeing. NRG supports HR professionals in the manufacturing, resources and energy/infrastructure sectors, and the annual conference brings together members to network, share and build professional knowledge, gain insights into industry developments and foster relationships.
