The Commonwealth Government has just released an exposure draft of legislation that will replace Australia's voluntary ACCC merger clearance process with a process by which it will be mandatory for parties to notify the ACCC of any merger that meets certain thresholds. The changes represent a complete change to Australia's merger regime.
