Last week, the Privacy and Other Legislation Amendment Bill was introduced into Parliament, marking the beginning of major privacy reform. In my first summary article below, I consider four key provisions that will impact businesses: 1. Amendments to Australian Privacy Principle (APP) 11 to test whether technical and organisational measures are reasonable under the circumstances 2. Additional powers for OAIC to issue infringement notices for privacy breaches and to conduct public inquiries 3. New statutory tort that gives individuals the right to seek compensation from businesses for harm caused by a privacy breach 4. Requirement for businesses to disclose information in their privacy policies about automated decisions that affect the rights or interests of an individual. The Bill sets the stage for necessary policy and procedure uplifts, or, at the very least, a critical review of current practices. There will be more to come but, in the meantime, please drop me a line if you have any questions or thoughts.
