Has your trade mark been rejected by IP Australia? We are seeing more and more applications being rejected by IP Australia in recent years whether because of similarity to existing marks, overly descriptive or generic terms, lack of distinctiveness or for other less common reasons. This may be attributed to the increased number of trade marks being filed in Australia meaning it is vitally important to consider upfront what objections your trade mark may face during examination to minimise rejection. Ensuring your trade mark is unique, accurately represented, and compliant with regulations can help avoid these pitfalls and improve your chances of approval. Consider a comprehensive pre-filing search. While a search may increase costs initially, it may save you a lot of time and money in the long run. #ttademarks #intellectualproperty

Understanding the differences between registered designs and 3D trade marks in Australia is crucial for protecting your product's appearance. Registered designs safeguard the visual aspects of a product, focusing on its shape, pattern, or ornamentation for up to 10 years only. In contrast, 3D trade marks protect the distinctive shape or configuration of a product as a brand identifier, offering indefinite protection as long as it remains distinctive and in use. Choose the right protection based on whether you seek to secure the visual design itself or its role as a brand identifier. find out more here: https://lnkd.in/gn4JtneA #IntellectualProperty #Design #Trademark

QATAR - WIPO RELEASES FEES FOR DESIGNATING QATAR UNDER THE MADRID PROTOCOL. By way of an update to my earlier post regarding Qatar acceding to the Madrid Protocol, the WIPO fees to designate this country under an international registration are 1,427CHF per class. While these fees are not insignificant by any stretch, there are advantages to filing your brand in Qatar using the Madrid system, including for example that the filing requirements are less onerous than filing directly into Qatar. For more information or, if you are interested in expanding your brand to Qatar, get in touch with us at [email protected]. #madridprotocol #trademarks
