- The original upload cites [1] as the source, *not* the public domain NASA image currently listed. (This image is higher resolution than the NASA image cited as the source: further processing has clearly been done by someone, which immediately negates the claim that it is a NASA public domain image.) - What underlying work? The photo of the city? I don't see anything else; if this was truly a user photo which was licensed, I think it would be OK. But I think the same image appears on the Rent musical facebook page,[5] so it's probably just a copy taken off the internet, and should be deleted. - The provided reason for this to be PD is "official item legally exempt from copyright in its country of origin". However, the source is the Florida State Parks under the Florida Department of Environmental Protection. So is not a part of the national government and the PD-US-Gov licenses.We have Template:PD-FLGov and Commons:Template:PD-FLGov but I do not think that this photo falls natually under the text in the templates. - It's not PD-USGov, but I don't see why that would not fall under PD-FLGov; that covers basically all works created by the state, unless they do not qualify as a public record, or if the state legislature has legislated an exception granting a particular body to copyright their work. As of 2006, per this report, the Department of State, projects of the Florida Space Authority, Department of the Lottery, the Department of Transportation, the Department of Citrus, water management districts, and the Florida Institute of Phosphate Research are allowed to copyright their works, as well as instructional materials and ancillary written documents across the government, and (I think as a result of the linked paper) perhaps software in general. It's possible that additional exceptions have been legislated since then, but we'd have to see that the state parks or Department of Environmental Protection was given the ability. The scope of public records is very broad; it would cover most things except records which might violate personal privacy, or classified information, or some things like that. Pretty similar to PD-USGov in that regard. The statue itself would not be PD-FLGov (not created by the government), but it would appear to be PD-US-no_notice.[6] Carl Lindberg (talk) 15:39, 27 June 2012 (UTC)[reply]
