Map created by a private organization and local government, and submitted to the US National Park Service as part of an application. The uploader claims that the submission process makes the work public domain. But by NPS policy, copyright is still held by the creator. Wikiacc (¶) 02:16, 18 May 2020 (UTC)
- Keep - 1. This image is a "sketch map" that was included as an attachment to NPS Form 10-900, "National Register of Historic Places Registration Form," in Section 11 - Additional Documentation. The form containing this map, dated 8/12/11, was submitted to the National Park Service and is a public record under the laws of the United States. The image used in the wiki article is an image capture I made of the map directly from the public record. My reading of the NPS policy referenced in the nom does not prohibit content on its site for being used for other purposes. Rather, there is a disclaimer that says some content may be copyrighted or have other protections limiting its use, so therefore it is the user's "responsibility to determine what permission(s) you need in order to use the content and, if necessary, to obtain such permission." I am of the opinion that a factual basis has been established that this map is in the public domain and that its use is consistent with NPS policy. 2. The historic district application containing this map was prepared by Pamela O'Conner of Preservation Practices, working under contract for the City of Buchanan, MI. The scope of work was to prepare and submit the NPS application on behalf of the City. As Mrs. O'Conner was working as an agent of the City and since the map was a work product resulting from an expenditure of public funds, the application form and all supporting documents including the map are a public record under the laws of the State of Michigan. The City of Buchanan is a second source of the map as a public record. The Buchanan Preservation Society (a 401-3c) was a non-profit coordinating partner on the project and has no ownership of the NPS form & accompanying documents such as the map. Perhaps I did not include adequate notes when attaching the image to the article and welcome the assistance of other editors to improve documentation concerning the origin of the map, my creation of the image of the map, and the factual basis that it is in the map itself is in the public domain. ... -- Jasonlietz (talk) 21:23, 18 May 2020 (UTC)
- @Jasonlietz: Note that public domain (absence of copyright) is not the same as public record (anyone may access). Do you have evidence that work product of the City of Buchanan is free of copyright? Or evidence that submissions to the National Park Service are free of copyright?
