Kept: Movie is in the public domain. I don't think coloring is creative enough, even when it is itself derivative of the original prints (as stated in the previous nomination). Had the musicalized version been uploaded it would have certainly been deleted, but this muted version is completely fine as it is firmly in the public domain in the US. --Bedivere (talk) 04:57, 14 April 2024 (UTC)[reply]

Although the original movie is public domain, this particular restoration apparently contains new copyrightable elements: "No single, complete, copy of the film is known to survive. This restoration is based [on] an incomplete 35mm print and a separate small roll of shots preserved at the Library of Congress National Audio-Visual Conservation Center, and a 35mm copy of a Russian version, based on an export negative preserved at Gosfilmofond of Russia. In two sequences, still images have been inserted to bridge gaps where motion picture material was not available. Shot continuity and text for re-created intertitles and bridging stills are based on director Irvin Willat's original script and continuity. Color tinting and toning have [been] reproduced based on the laboratory notations in the leaders of the Library of Congress print." There is no commercial Freedom of Panorama in Azerbaijan, and these commercially-licensed images infringe the posthumous copyright of the work author, w:en:Sargis Baghdasaryan (died June 19, 2001). The monument dates to 1967. Even if Nagorno-Karabakh is claimed to still exist as a country with "limited int'l recognition", they did not have a suitable, commercial Freedom of Panorama anyway.

    @Laurel Lodged no, public art is subject to copyright. It is a default rule of all countries that are Berne signatories like Azerbaijan (note that the former Soviet Union had copyright law that only allows non-commercial FoP for anything in public). It is up to the opponents of this deletion request (per COM:EVID) to present proof that the sculptor indeed surrendered his economic rights to the state (yet in usual cases, the copyright was simply transferred, not extinguished). It also has been the norm to delete all post-World War II public monuments of Azerbaijan; see Category:Azerbaijani FOP cases/deleted for past deletion requests, since the country's copyright law just inherited the Union Soviet-era FoP that disallows commercial uses of anything permanently seen and accessible in public spaces. The essence of Freedom of Panorama is that commercial uses of buildings and public art are safeguarded, not prohibited or curtailed, by law, something Azerbaijan does not allow. Further clarification: Back in May 2024, when an issue was raised with the permission/license it was originally uploaded under, The Emperor of Byzantium brought up that you can find under Rights "We encourage the use and reuse of our collection data. Data in the title, made, maker and details fields are released under Creative Commons Zero Descriptions and all other text content are licensed under a Creative Commons Attribution 4.0 licence...
That information doesn't refer to the actual image, it refers to information for the catalog entry, such as the the description, the item's title, similar text they wrote on their website. However, when you click on "Use this Image" on their website, it says "This image is released under a CC BY-NC-SA 4.0 Licence". Regarding File:Yavarehamedan.jpg - If you took it, why did you cut the person's head out of the background ?
Regarding File:Amin allah rezayi photo.jpg - If you took it, why are the fingertips and the copyright statement found at https://seemorgh.com/culture/visual-arts/91049-91049/ gone?
Regarding File:AnjomanIran Khordad1325.jpg - if you took it, why is it incorrectly dated? It can't be 2020 because in the description, "Ghasemi (Minister of Culture at the time)" - no such minister of culture now, and it is not "at that time." On the Farsi Wiki page where it is in use "Iranian Literary Association, June 1961, Journey to Hamedan." There is no Freedom of Panorama in the Philippines. The sculpture of Antonio Pigafetta located in Plaza Independencia, Cebu City was sculpted in 1980 by National Artist Abdulmari Imao according to the National Quincentennial Committee Philippines official website. There is no Freedom of Panorama in the Philippines. According to this plaque, the shrine was established in 1998. It is likely the sculpture dates at around the same time, and so the sculptor isn't yet dead for more than 50 years for it to fall into public domain and for it to be commercially-exploitable.

As per source, this is a photograph of a page from the 1999 book, The Millennium President by Adrian E Cristobal. There is no proper author credit. The origin of this portrait is dubious. It could either be a work of a employee of the Philippine government or a donation by a private citizen who is a supporter of Estrada which would make the copyright status of the image under a gray area. I was not authorised to publish this version.
